Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of protection of children from all forms of violence.

Article 2. Legislation on protection of children from all forms of violence

The legislation on protection of children from all forms of violence consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about protection of children from all forms of violence then are applied rules of the international treaty.

The state accepts the adequate legal, administrative, social, economic and other measures for protection of children from all forms of violence, including support of the child and his family, and creates the effective mechanisms necessary for identification and prevention of cases of all forms of violence against children and among children, informing on cases of violence against children, investigation of these facts, ensuring inevitability of involvement of perpetrators to responsibility, recovery of victims of violence and recovery of their rights and social adaptation.

Article 4. Basic principles of protection of children from all forms of violence

The basic principles of protection of children from all forms of violence is the following:

legality;

humanity;

ensuring the best interests of the child;

ensuring equal rights and opportunities of children;

non-admission of discrimination of children;

participation of the child in decision making, the interests concerning it;

intolerance to violence against children;

inevitability of responsibility for violence against children;

recovery of the rights of the victim of violence.

Article 5. Rights of victims of violence

The victim of violence the child, the victim of any kind of violence is recognized.

The victim of violence has the right on:

protection against all forms of violence;

the appeal to the relevant state bodies and the organizations or to court according to the procedure, established by legal acts directly or through the legal representative with the statement for making or threat of making of violence against it;

receipt of free legal, economic, public, psychological, medical and other assistance, including the help provided through free network of phone line (telephone hotline);

the appeal to the relevant state bodies is direct or through the legal representative with the requirement about issue of the security order, and in case of violation of conditions of the security order informing on it;

compensation of the caused material damage and compensation of moral harm owing to the violence committed concerning it.

The victim of violence can have and other rights according to the legislation.

Protection of the rights, freedoms and legitimate interests of the child is performed by his parents, persons replacing them, and in the cases provided by the law - guardianship and custody body, the prosecutor, court.

The victim of violence and his legal representative in case of appeal to the court with the statement for compensation of material damage and compensation of moral harm are exempted from payment of the state fee.

The main directions of state policy in the field of protection of children from all forms of violence are:

development and implementation of state programs and strategy in the field of protection of children from all forms of violence;
