This Instruction based on Item 3 of part 2 of article 5 of the Federal Law of July 18, 2009 No. 190-FZ "About credit cooperation" and according to the solution of the Board of directors of the Bank of Russia (the minutes of the Board of directors of the Bank of Russia of September 25, 2024 No. PSD-31) establish procedure for forming of reserves by credit consumer cooperatives on possible losses on loans.
1. Reserves on possible losses on loans shall be created by credit consumer cooperative (further - credit cooperative) based on accounting data quarterly as of the last number of quarter according to the following requirements for the loan agreements signed by credit cooperative (further - the signed loan agreement), and according to the loan agreements acquired by credit cooperative (further - the acquired loan agreement) (further in case of joint mentioning - the loan agreement):
on principal debt, the added percent, other payments for benefit of credit cooperative, and also on penalty (penalties, penalty fee) in the amount awarded by court or recognized by the borrower according to the signed loan agreement;
on principal debt, the added percent, other payments for benefit of the creditor, and also on penalty (penalties, penalty fee) in the amount awarded by court or recognized by the borrower according to the acquired loan agreement in the amount equal to value of acquisition by credit cooperative of the specified requirements;
on percent, other payments for benefit of credit cooperative, and also on penalty (penalties, penalty fee) in the amount awarded by court or recognized by the borrower according to the acquired loan agreement, the credit cooperative of the specified requirements added from the date of acquisition.
