About modification of the Order of the Government of the Russian Federation of December 29, 2011 No. 1178

The government of the Russian Federation decides:

1. 2. Determine that in case of establishment for 2025 of the prices (rates) for services in transfer of electrical energy on the power networks belonging on the property right or on other legal cause to the territorial network organizations for which 2025 is the next year of the long-term period of regulation and the specific size of the operating (under control) expenses determined for 2025 according to the methodical instructions provided by Items 32 or 38 of Bases of pricing in the field of regulated prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry" counting on unit of quantity of the assets necessary for implementation of regulated activities in 2025 exceeds the specific size of operating (under control) expenses of the territorial network organization, which corresponds for 2025 to the criteria of reference of the territorial network organization to the largest territorial network organization in administrative borders of the subject of the Russian Federation provided by appendix No. 3(1) to the pricing Bases in the field of regulated prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry" counting on unit of quantity of the assets necessary for implementation of regulated activities in 2025 provisions of Item 3 of this resolution are applied.

3. To executive bodies of subjects of the Russian Federation in the field of state regulation of rates in case of establishment for 2025 of the prices (rates) for services in transfer of electrical energy on the power networks belonging on the property right or on other legal cause to the territorial network organizations specified in Item 2 of this resolution to consider the operating (under control) expenses determined according to the paragraph third this Item, increased by the size equal to 50 percent of difference between:

the operating (under control) expenses of the territorial network organization determined according to the methodical instructions provided by Items 32 or 38 of Bases of pricing in the field of regulated prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry";

the operating (under control) expenses of the territorial network organization determined in case of observance of condition of not exceeding of specific size of operating (under control) expenses counting on unit of quantity of the assets necessary for implementation of regulated activities in 2025 over the specific size of operating (under control) expenses (basic level of operating (under control) expenses) of the territorial network organization which corresponds for 2025 to the criteria of reference of the territorial network organization to the largest territorial network organization in administrative borders of the subject of the Russian Federation provided by appendix No. 3(1) to the pricing Bases in the field of regulated prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry" counting on unit of quantity of the assets necessary for implementation of regulated activities in 2025.

4. In case of origin at the territorial network organizations of the half-received income connected with implementation of regulated activities, as a result of price fixation (rates) and the sizes of necessary gross revenue of the territorial network organizations taking into account Item 2 of this resolution compensation to such territorial network organizations of the half-received income connected with implementation of regulated activities by them at the expense of means of budgets of budget system of the Russian Federation according to article 23 of the Federal law "About Power Industry" is not performed.

5. Provisions of this resolution are not applied in case of determination of size of operating (under control) expenses (basic level of operating (under control) expenses) of the territorial network organizations which are not corresponding to the criteria of reference of the territorial network organization to the largest territorial network organization in administrative borders of the subject of the Russian Federation provided by appendix No. 3(1) to the pricing Bases in the field of regulated prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry":

technologically isolated territorial electric utility systems functioning in and in the territories which are technologically not connected with Power pool system of Russia and technologically isolated territorial electric utility systems;

which have more than 80 percent of quantity of the conventional units relating to assets and objects of electric grid economy, participating in regulated activities is located in the territories of the region of the Far North and areas equated to the region of the Far North;

for which the long-term prices (rates) are established on the basis of concluded according to the procedure, determined by the Rules of the conclusion, change and agreement cancelation about conditions of implementation of regulated types of activity approved by the order of the Government of the Russian Federation of August 31, 2023 No. 1416 "About agreements on conditions of implementation of regulated types of activity", agreements on conditions of implementation of regulated types of activity.

6. To Federal Antimonopoly Service:

a) together with the Ministry of Energy of the Russian Federation and the Ministry of Economic Development of the Russian Federation to provide till June 25, 2025 to the Government of the Russian Federation the draft of the act providing introduction of the reference principle of forming of operating expenses of the network organizations in case of establishment of rates for services in transfer of electrical energy;

b) with participation of the Ministry of Economic Development of the Russian Federation and Ministry of Energy of the Russian Federation till January 22, 2025 to prepare and provide to the Government of the Russian Federation offers on entering into regulatory legal acts of the Government of the Russian Federation of the changes providing application of index of increase in efficiency of operating (under control) expenses of the territorial network organizations concerning which the following conditions in total are complied:

the territorial network organization corresponds for the next period of regulation to the criteria of reference of the territorial network organization to the largest territorial network organization in administrative borders of the subject of the Russian Federation provided by appendix No. 3(1) to the pricing Bases in the field of regulated prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry";

in the next period of regulation the specific size of operating (under control) expenses (basic level of the operating (under control) expenses) of the territorial network organization determined according to the methodical instructions provided by Items 32 or 38 of Bases of pricing in the field of regulated prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry" counting on unit of quantity of the assets necessary for implementation of regulated activities in the next period of regulation exceeds similar indicator of specific size of operating (under control) expenses (basic level of operating (under control) expenses) of any of the territorial network organizations functioning in administrative borders of the same subject of the Russian Federation.

7. This resolution becomes effective from the date of its official publication.

Changes which are made to the Order of the Government of the Russian Federation of December 29, 2011 No. 1178

1. In pricing Bases in the field of regulated prices (rates) in power industry approved by the specified resolution:

a) in Item 34:

Provisions of the paragraph of the fifteenth this Item are not applied in case of determination of size of operating expenses (basic level of operating expenses) of the territorial network organizations which are not corresponding to the criteria of reference of the territorial network organization to the largest territorial network organization in administrative borders of the subject of the Russian Federation provided by appendix No. 3(1) to this document:

technologically isolated territorial electric utility systems functioning in and in the territories which are technologically not connected with Power pool system of Russia and technologically isolated territorial electric utility systems;

which have more than 80 percent of quantity of the conventional units relating to assets and objects of electric grid economy, participating in regulated activities is located in the territories of the region of the Far North and areas equated to the region of the Far North;

for which the long-term prices (rates) are established on the basis of concluded according to the procedure, determined by the Rules of the conclusion, change and agreement cancelation about conditions of implementation of regulated types of activity approved by the order of the Government of the Russian Federation of August 31, 2023 No. 1416 "About agreements on conditions of implementation of regulated types of activity", agreements on conditions of implementation of regulated types of activity.";

b) add Item 37 with the paragraph of the following content:

"In case of annual adjustment of necessary gross revenue of the network organizations the operating expenses (basic level of operating expenses) determined taking into account the features established in paragraphs the fifteenth - the nineteenth Item 34 of this document are considered.";

c) in Item 38:

to add the paragraph of the eighth with words ", taking into account features, the established in paragraphs nine - the thirteenth this Item";

after the paragraph of the eighth to add with paragraphs of the following content:

"The under control expenses (basic level of under control expenses) considered in case of state regulation of the prices (rates) in power industry shall not exceed the level of such expenses determined in case of observance of condition of not exceeding of specific size of under control expenses (basic level of under control expenses) counting on unit of quantity of the assets necessary for implementation of regulated activities over the specific size of operating (under control) expenses (basic level of operating (under control) expenses) of the territorial network organization which corresponds for the next period of regulation to the criteria of reference of the territorial network organization to the largest territorial network organization in administrative borders of the subject of the Russian Federation provided by appendix No. 3(1) to this document counting on unit of quantity of assets, necessary for implementation of regulated activities in the next period of regulation.

Provisions of the paragraph of the ninth this Item are not applied in case of determination of size of under control expenses (basic level of under control expenses) of the territorial network organizations which are not corresponding to the criteria of reference of the territorial network organization to the largest territorial network organization in administrative borders of the subject of the Russian Federation provided by appendix No. 3(1) to this document:

technologically isolated territorial electric utility systems functioning in and in the territories which are technologically not connected with Power pool system of Russia and technologically isolated territorial electric utility systems;

which have more than 80 percent of quantity of the conventional units relating to assets and objects of electric grid economy, participating in regulated activities is located in the territories of the region of the Far North and areas equated to the region of the Far North;

for which the long-term prices (rates) are established on the basis of concluded according to the procedure, determined by the Rules of the conclusion, change and agreement cancelation about conditions of implementation of regulated types of activity approved by the order of the Government of the Russian Federation of August 31, 2023 No. 1416 "About agreements on conditions of implementation of regulated types of activity", agreements on conditions of implementation of regulated types of activity.";

to pricing Bases in the field of regulated prices (rates) in power industry

Criteria of reference of the territorial network organization to the largest territorial network organization in administrative borders of the subject of the Russian Federation

The territorial network organization which is not rendering service in transfer of electrical energy with use of objects of electric grid economy which nominal class of tension constitutes 500 kV, owning on the property right and (or) on other legal cause during term at least 5 years in a row preceding year in which the largest territorial network organization is determined and for the term of at least 5 years estimated since the beginning of the specified year located and used for implementation of regulated activities in the field of rendering services in transfer of electrical energy in administrative borders of the subject of the Russian Federation treats the largest territorial network organization:

transformer and other substations with the established power transformers (autotransformers) which value of the amount of rated power is the greatest of the amounts of rated power of transformer and other substations which belong to any of the territorial network organizations on the property right or on other legal cause using them for implementation of regulated activities in the field of rendering services in transfer of electrical energy in administrative borders of the subject of the Russian Federation (at the same time the rated power of transformer and other substations which are at the same time used by the territorial network organizations for satisfaction of own needs which are not connected with use of these objects for implementation of regulated activities in the specified sphere is not considered);

power lines (air and (or) cable) project class of 110 kV and above which amount of extents on the route is the greatest of the amounts of extents on the route in relation to those power lines (air and (or) cable) with similar class of tension which belong to any of the territorial network organizations using them for implementation of regulated activities in the field of rendering services in transfer of electrical energy in administrative borders of the subject of the Russian Federation (at the same time the extent of lines (air and (or) cable is not considered), which are at the same time used by the territorial network organizations for satisfaction of own needs which are not connected with use of these objects for implementation of regulated activities in the specified sphere);

power lines (air and (or) cable) at least 2 project nominal classes of tension from the following classes of tension: 35 kV; 1 - 20 kV; it is lower than 1 kV - three-phase sites of power lines;

power lines (air and (or) cable) which amount of extents on the route is the greatest in comparison with the amount of extents on the route of power lines (air and (or) cable) which are owned with observance of requirements of paragraph one of this document by each of the territorial network organizations corresponding to the criteria specified this document in paragraph four, to criteria of reference of owners of objects of electric grid economy to the territorial network organizations approved by the order of the Government of the Russian Federation of February 28, 2015 No. 184 "About reference of owners of objects of electric grid economy to the territorial network organizations", using such objects for implementation of regulated activities in the field of rendering services in transfer of electrical energy in administrative borders of the subject of the Russian Federation (it is applied only in case, if to determine the largest territorial network organization using the criteria specified in paragraphs second and third this document it is impossible, at the same time the extent of lines is not considered (air and (or) cable) which are at the same time used by the territorial network organizations for satisfaction of own needs which are not connected with use of these objects for implementation of regulated activities in the specified sphere).".

2. The prices (rates) in power industry approved by the specified resolution to state the subitem 8 of Item 23 of Rules of state regulation (review, application) in the following edition:

"8) the analysis of compliance of the organization to criteria of reference of owners of objects of electric grid economy to the territorial network organizations, and also the criteria of reference of the territorial network organization to the largest territorial network organization in administrative borders of the subject of the Russian Federation provided by appendix No. 3(1) to pricing Bases;".
