Chapter 1. General provisions

Article 1. The relations regulated by this Federal Law

1. This Federal Law governs the relations in the field of creation, forming, preserving, development, studying and use of the biological (bioresource) collections which are in federal property and formation of the bioresource centers and the organization of their activities.

2. Provisions of this Federal Law are not applied to the relations connected with creation, forming, preserving, development, studying and use of collections of pathogenic microorganisms and viruses, the state collection of representatives of normal microflora of the person, farm animals and plants, cryogenic banks of samples of natural normal microbiocenoses (biomaterials), and also collections of biological materials of the person.

3. The provisions of this Federal Law established for biological (bioresource) collections are applied to national collections of especially valuable samples of genetic resources if other is not established by this Federal Law.

4. The provisions of this Federal Law established for the bioresource centers are applied to the national centers of genetic resources if other is not established by this Federal Law.

Article 2. The basic concepts used in this Federal Law

1. For the purposes of this Federal Law the following basic concepts are used:

1) biological (bioresource) collection - purposefully created scientifically systematized fund of the passported biological samples of natural and (or) artificial origin having general set of specific characteristics kept in controlled conditions with respect for genetic purity, integrity and authenticity (authenticity) of materials and used for scientific, scientific and technical and (or) educational activities;

2) biological resources - biological objects or their set and information on them;

3) biological sample - biological object of natural or artificial origin, purposefully collected (selected) for the purpose of carrying out researches, or set of such biological objects;

4) biological object - live organism (the representative of animals, plants, mushrooms or bacteria) or its fragment or virus;

5) biological diversity - variability of live organisms and viruses from all sources, including land, marine and other water ecosystems and ecological complexes which part they are, including variety within type, between types and variety of ecosystems;

6) the bioresource center - the scientific or educational organization providing forming, preserving, development, studying and use of biological (bioresource) collection or several biological (bioresource) collections;

7) genetic resources - the genetic materials having the actual or potential value;

8) genetic material - the biological sample containing molecules of nucleic acids (deoxyribonucleic acid and (or) ribonucleic acid) of this biological sample, or allocated from biological sample of molecule of nucleic acids (deoxyribonucleic acid and (or) ribonucleic acid);

9) genetic variety - biological diversity within type;

10) storage unit - physically isolated accounting unit of sample of biological (bioresource) collection kept in biological (bioresource) collection according to the procedure, provided by national standards in the field of preserving biological (bioresource) collections;

11) the catalog of biological (bioresource) collection - the systematized list of information on samples of biological (bioresource) collection;

12) materials of sample of biological (bioresource) collection - artificially allocated for use of part (elements) of sample of biological (bioresource) collection containing genetic material of sample of biological (bioresource) collection;

13) the interdepartmental commission on questions of forming, preserving and use of collections of genetic resources - the collegiate organ performing coordination of activities of the national center of genetic resources (further also - the interdepartmental commission);

14) national collection of especially valuable samples of genetic resources - biological (bioresource) collection which is in federal property and which samples answer the criteria approved by the federal executive body performing functions on development and realization of state policy and normative legal regulation in the field of scientific and scientific and technical activities in coordination with the interdepartmental commission;

15) the national catalog of especially valuable samples of genetic resources - the systematized list of information on samples of national collection of especially valuable samples of genetic resources;

16) the national center of genetic resources - the bioresource center formed according to the decision of the President of the Russian Federation based on the leading scientific organizations, providing forming, preserving, development, studying and use of biological (bioresource) collections of especially valuable samples of genetic resources in the respective sphere;

17) sample of biological (bioresource) collection - the biological sample passported and registered in biological (bioresource) collection;

18) especially valuable sample of genetic resources - sample of biological (bioresource) collection which genetic material is of the special value determined according to the procedure, established by this Federal Law;
