The purpose of this Law is regulation of the relations in the field of rail transport.
The legislation on rail transport consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about rail transport then are applied rules of the international treaty.
In this Law the following basic concepts are applied:
baggage - the things belonging to the passenger, accepted for shipment in the luggage car according to the travel document (ticket);
the operator of cars (containers) - the legal entity owning cars (containers) on the property right or other legal causes, participating on the basis of the contract with carrier of rail transport in transportation process by rendering services and specified in carriage documents;
the passenger - the physical person having the travel document, making trip in the train or being in the territory of the railway station (station) or passenger platform just before trip or directly after it;
the travel document (ticket) - the carriage document of the established sample certifying the conclusion of the transportation agreement of the passenger railway transport public;
carrier - the legal entity having the license for activities for transportation of passengers and loads by railway transport of the internal and international message, who assumed according to the transportation agreement by rail obligation to bring the passenger, the baggage entrusted to it by the consignor (sender), cargo baggage, load, post and express departures from the point of departure in destination, and also to issue baggage, cargo baggage, load, post and express departures to the consignee (receiver);
transportation process - set organizationally and technologically interconnected actions and transactions which are carried out by the companies of rail transport public, carrier, the operator of cars (containers), the operator of infrastructure by preparation, implementation and completion of transportations of passengers, baggage, cargo baggage, loads, post and express departures;
the carriage document - the document in the form of the travel document (ticket), the luggage receipt, the railway way bill, the card with the electronic medium of information or other data carrier confirming the conclusion of the transportation agreement of passengers, baggage, cargo baggage, loads, post and express departures;
the railway station - the separate Item having additional groups of railway tracks, in addition to the main railway tracks, the transactions allowing to make on acceptance, departure, skreshcheniye and overtaking of trains, transactions on acceptance, issue of baggage, cargo baggage, loads, post and express departures, servicing of passengers, shunting work on disbandment and forming of trains and technical transactions with trains;
rail transport - the mode of transport consisting of rail transport of general and uncommon use and intended for ensuring requirement of legal entities and physical persons for transportations on railway tracks;
infrastructure of rail transport - the technological complex including railway tracks, railway stations, devices of electric utility service, communication network, system of the alarm system, centralization and blocking, information complexes, traffic control system, buildings, constructions, devices and the equipment providing functioning of this technological complex;
object of rail transport - the infrastructures of rail transport and its components, stations, railway vehicles, rail transport public and rail transport of uncommon use which are in operation;
railway tracks of uncommon use - the railroad side tracks adjoining directly or through other railroad side tracks railway tracks public and also the railway tracks which are not adjoining railway tracks public, intended for servicing of consignors (senders) and consignees (receivers) on the terms of agreements or accomplishment of technological works for own needs of the owner of these ways;
rail transport of uncommon use - set of the production and technological complexes belonging to legal entities, including railway rolling stock and infrastructure facilities of rail transport of uncommon use, intended for ensuring requirements of legal entities and physical persons for transportations on the basis of agreements and also for own needs in places of uncommon use;
railway tracks public - the railway tracks belonging to authorized organization in the field of rail transport public and to its divisions on which within strip of branch stages, the railway stations, traveling, obgonny Items open for accomplishment of the corresponding transactions according to the omission, acceptance and departure of trains, receiving and delivery of baggage, cargo baggage, loads, post and express departures, and servicing of passengers, production of shunting work are located;
rail transport public - the single production and technological complex including infrastructure of rail transport, railway rolling stock, other property and intended for ensuring requirement of legal entities and physical persons for transportations on the basis of public agreements;
the operator of infrastructure of rail transport public (further - the operator of infrastructure) - the legal entity belonging to authorized organization in the field of rail transport public, performing operation, the current content and upgrade, construction of railway tracks public and other infrastructure facilities of rail transport public, and also rendering the services of use of infrastructure including connected with use of railway tracks of general use for the omission and movement of railway vehicles;
the companies of rail transport public - structural divisions and affiliated economic societies of authorized organization in the field of rail transport public, the main activities of which are directly connected with preparation and ensuring transportation process;
load - the object accepted for rail hauling of rail transport public by the company, carrier for timeliness of delivery and which safety they bear responsibility;
cargo baggage - the object of rail hauling transported in passenger and post and luggage trains;
the consignor (sender) - the legal entity or physical person acting on its own behalf or on behalf of the owner of load or cargo baggage and specified in carriage documents;
the consignee (receiver) - the legal entity or physical person authorized on receipt of load or cargo baggage;
hand luggage - the personal belongings of the passenger having restriction on weight and the sizes, transported by the passenger with themselves in the car without payment;
railway rolling stock (further - railway vehicles) - locomotives, cargo, luggage, cars of locomotive draft and motorvagonny railway vehicles, and also other vehicles intended for ensuring implementation of transportations and functioning of rail transport.
The basic principles of activities of rail transport are:
legality;
safety;
openness and transparency;
stability;
ecological compatibility;
availability and service quality of rail transport;
equality in use of infrastructure of rail transport;
integrity and uninterruptedness of functioning of infrastructure of rail transport.
The main directions of state policy in the field of rail transport are:
safety of rail haulings of passengers and loads;
