About modification of some legal acts of Ukraine concerning enhancement of execution of the punishment in the form of penalty and social jobs

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Penitentiary code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2004, Art. No. 3-4, 21):

The text of Article 12 to state 1) in the following edition:

"Bodies of the public executive service carry out punishment in the form of confiscation of property and penalty in cases and according to the procedure, provided by this Code and the laws of Ukraine";

The paragraph third to state 2) to part one of Article 13 in the following edition:

"execution of the punishment in the form of deprivation of the right to hold certain positions or to be engaged in certain activities, social or corrective works, probation of supervision, and also penalty according to the procedure, provided by this Code";

To add 3) with Article 13-1 of the following content:

"Article 13-1. Payment of the expenses connected with execution of the judgment

1. Convicts to mulctary punishment, deprivation of the right to hold certain positions or to be engaged in certain activities, social or corrective works, probation of supervision and exempted from serving sentence with testing pay the expenses connected with execution of the judgment.

Minors, persons with disability of the first or second group are exempted from payment of the expenses connected with execution of the judgment, persons who are on child care leave before achievement of three-year age by it, persons are more senior than sixty years which do not work and do not receive pension.

In case of cancellation of the judgment payment of the expenses connected with execution of the judgment is not performed, and earlier paid expenses are subject to return.

The maximum size of the expenses connected with execution of the judgment cannot exceed 50 percent of the subsistence minimum for able-bodied persons established for January 1 of calendar year in which the corresponding judgment is made.
