About modification of some legal acts of Ukraine concerning enhancement of regulations on judicial control of execution of judgments

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Economic Procedure Code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2017, No. 48, the Art. 436):

Part one of Article 135 to add 1) with the paragraph the seventh the following content:

"When implementing judicial control of execution of the judgment the court can collect in the income of the government budget from the defendant, the debtor or their heads (if the defendant, debtor is the legal entity) penalty in the amount from twenty to forty sizes of subsistence minimum for able-bodied persons";

Part one of Article 237 to add 2) with Item 5-1 of the following content:

"Whether 5-1) there are bases for implementation of the judicial control provided by part five of Article 345-1 of this Code";

Part the sixth Article 238 to add 3) with Item 5-1 of the following content:

"5-1) implementation of the judicial control provided by part five of Article 345-1 of this Code";

Part one of Article 255 to add 4) with Items 36 and 37 of the following content:

"36) about refusal in allowance of the application about the obligation of the debtor to submit the performance report of the judgment;

37) about acceptance or refusal in adoption of the report of the debtor on execution of the judgment";

Part one of Article 328 to add 5) with the paragraph the second the following content:

"If the judgment based on which the executive document is issued or the decision which is subject to execution took legal effect, then lack of materials of legal case in connection with their reclamation of appeal or cassation instance by court does not interfere with consideration of the application, provided by paragraph one of this part, except case of suspension of execution of the judgment by court of cassation instance or suspension of enforcement proceeding";

6) in Article 331:
