About modification and amendments in the order of the acting minister on investments and development of the Republic of Kazakhstan of February 24, 2015 No. 198 "About approval of Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan"

I ORDER:

1. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of February 24, 2015 No. 198 "About approval of Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts for No. 12073) the following changes and amendments:

"According to subitem 41-22) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" I ORDER:";

in the Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan approved by the specified order:

state Item 3 in the following edition:

"3. The following effective period on stated below documents is established from the moment of their issue:

the certificate of the flight validity – one year;

the certificate on noise – termless;

the export certificate – thirty calendar days;

permission to accomplishment of special flight (the special certificate of the flight validity) – thirty calendar days;

permission to use the radio-transmitting equipment – termless;

the decision on recognition valid the certificate of the flight validity of the civil aircraft issued by foreign state (further – the decision on recognition of the certificate) – the term specified on the certificate of the flight validity of the civil aircrafts issued by foreign state.";

"5. In these rules the following terms and determinations are used:

1) authorized organization in the field of civil aviation (further – authorized organization) – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

2) design like the civil aircraft – information data set necessary for type definition of the aircraft, the engine or the air screw for the purpose of establishment of the flight validity according to requirements of the order of the acting minister for investments and development of the Republic of Kazakhstan of March 27, 2015 No. 367 "About approval of airworthiness standards of civil aircrafts of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts for No. 12038);

3) the state of developer – the state having jurisdiction concerning the organization responsible for type design;

4) permission to use of the radio-transmitting equipment established on civil aircrafts – the document issued by authorized organization on use of the radio-transmitting equipment established on the civil aircraft;

5) operational documentation of aircrafts – documentation regulating flight and technical operation of aircrafts, including its maintenance and repair, and also containing service conditions and operational restrictions;

6) the form of the aircraft, engines and main aggregates – the main documents for accounting of operating time (calendar resource, hour resource, resource on landings) the aircraft equipment and its technical condition;

7) the certificate of the flight validity of the civil aircraft – the document issued by authorized organization, certifying compliance of the civil aircraft to airworthiness standards;

8) the request – the appeal of the applicant to authorized organization for receipt of the certificate of the flight validity, the export certificate, the certificate for noise, permissions to special flight (the special certificate of the flight validity), permissions to use of the radio-transmitting equipment and the Decision on recognition of the certificate;

9) the applicant – the physical person or legal entity which addressed to authorized organization for receipt of the certificate of the flight validity, the export certificate, the certificate for noise, permissions to special flight (the special certificate of the flight validity), permissions to the radio-transmitting equipment and the Decision on recognition of the certificate;

10) the directive on the flight validity – information directed to maintenance of the flight validity of the aircraft including engines and air screws, ensuring safe operation of the aircraft, and also the requirement for modification, replacement of component parts or in conducting check of the aircraft and (or) amending its operational restrictions and the operation manual;

11) airworthiness standards – requirements to design, parameters and flight qualities of the aircrafts and their components aimed at safety of flights;

12) the export certificate of the flight validity – the document issued by authorized organization, intended for export of the aircraft which is subject to exception of the State register of civil aircrafts of the Republic of Kazakhstan;

13) the decision on recognition valid the certificate of the flight validity (further – the Decision) – the document of the established sample issued by authorized organization, in the field of civil aviation, confirming compliance of the civil aircraft to requirements and standards of International Civil Aviation Organization (ICAO) and to the airworthiness standards established by the Republic of Kazakhstan;

14) suitable for accomplishment of flights – condition of the aircraft, Item of remote piloting, the engine, air screw or component in case of which they correspond to their approved design and conditions of their safe operation;

15) maintenance of the flight validity – package of measures by means of which compliance of the aircraft equipment to airworthiness standards and their maintenance in the condition necessary for safe operation throughout operational service life is provided;

16) the organization responsible for type design - the organization which owns the certificate of type or the equivalent document concerning type of the aircraft, the engine or the air screw issued by the state developer;

17) the certificate of type – the document issued by authorized organization in the field of civil aviation, the international organization in the field of the civil aviation performing certification of aircrafts, or foreign state for determination of design like the civil aircraft, the engine or the air screw and confirming design compliance to airworthiness standards;

18) the certificate on noise – the document issued by authorized organization, certifying compliance of the civil aircraft on noise on the area which is appendix to the certificate of the flight validity of the civil aircraft;

19) Area navigation (RNAV) – zone navigation;

20) CATEGORY (Cat. III) – conditions of limited visibility;

21) Minimum navigation performance specification (MNPS) – the minimum requirements to characteristics of navigation equipment.";

to state part one of Item 9 in the following edition:

"9. By provision by the applicant on the portal of incomplete document package according to the list provided in the List of the main requirements to rendering the state service in issue of the certificate of the flight validity, and (or) documents with the expired effective period authorized organization within two working days refuses acceptance of the request.";

the first and second Item 9-2 to state parts in the following edition:

"9-2. By results of the carried-out works on verification of operational documentation and survey of the aircraft with use of instructive material (according to the program of certified inspection of the flight validity of the aircraft), the authorized organization within 2 (two) working days draws up the appraisal report about serviceability of the civil aircraft (further – the appraisal report) according to appendix 2-1 to these rules which is integral part of the program of certified inspection.

Based on the positive appraisal report, the authorized organization draws up the Certificate of the flight validity according to appendix 3 to these rules or based on the negative appraisal report the motivated answer about refusal in rendering the state service according to appendix 3-3 to these rules in the bases specified in Item 9 of the List of the main requirements to rendering the state service in issue of the certificate of the flight validity is drawn up.";

state Item 11 in the following edition:

"11. Certified inspection of the flight validity of the aircraft is performed by aviation inspectors of authorized organization with use of instructive material (the program of certified inspection of the flight validity of the aircraft).";
