About introduction of amendments to the laws of the Azerbaijan Republic "About courts and judges" and "About Judicial and legal council"
Millie Majlis of the Azerbaijan Republic, being guided by Item 5 of part I of article 94 of the Constitution of the Azerbaijan Republic, decides:
Article 1. Make the following changes to the Law of the Azerbaijan Republic "About courts and judges" (Collection of the legislation of the Azerbaijan Republic, 1997, No. 5, Article 413 (volume I); 2024, No. 3, Article 413). 5 (book I), Article 486):
1.1. To exclude words from part one of Article 86 "provided with the corresponding regulatory legal acts";
1.2. To state the text of Article 93-3 in the following edition:
"Candidates for judgeship are selected on the basis of testing, written examination and interview". Examinations and interviews will be organized by Committee on elections of judges.
Results of tests and interviews are estimated by Committee on elections of judges. The committee on elections of judges can involve the commission which is specially created by it in consideration of the matter.
The screening committee of judges ranges the candidates who successfully passed examinations and interviews based on the points got by them.
Results of assessment of candidates are represented to Judicial and legal council. Judicial and legal council brings in the body (organization) determined by relevant organ of the executive authority, idea of appointment of candidates for positions of judges according to quantity of vacant positions of judges.
Persons whose powers were not expanded by results of assessment provided by part one of article 96 of this Law cannot participate in examinations and interviews in candidate screen on judgeship within 5 years.
Rules of candidate screen for vacancies of judges are determined by Judicial and legal council.";
