I. Make changes to such legal acts of Ukraine:

1. In the Civil code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2003, Art. No. No. 40-44, 356):

1) in Article 44:

the first and second to state parts in the following edition:

"1. Based on the judgment about recognition of physical person it is unknown absent the notary takes measures for establishment of guardianship over its property.

According to the statement of the interested person or guardianship and custody body the notary takes measures for establishment of guardianship over property of person, missing person in case of special circumstances, before adoption by court of the decision on recognition of such person is unknown absent.

Measures for establishment of guardianship over property of physical person, acknowledged it is unknown absent, or person, the missing person in case of special circumstances, are accepted by the notary by carrying out the inventory of the corresponding property and appointment of a guardian over such property.

2. The notary takes measures for establishment of guardianship over property of physical person, acknowledged is unknown absent, or person, the missing person in case of special circumstances, at the last place of residence of the corresponding person.

If the residence of physical person, acknowledged is unknown absent, or person, the missing person in case of special circumstances, it is unknown, the notary takes measures for establishment of guardianship over property of such person on the location of real estate or its main part, and in the absence of real estate - on the location of the main part of personal estate.
