About biological safety in the Kyrgyz Republic

This Law establishes precepts of law in the field of ensuring biological safety in the Kyrgyz Republic and fixes the state guarantees on protection of the population and the environment against possible adverse effects of impact of biological agents and use of products of modern biotechnology.

Article 1. Legislation of the Kyrgyz Republic on biological safety

1. The legislation of the Kyrgyz Republic on biological safety is based on the Constitution of the Kyrgyz Republic and consists of this Law, other regulatory legal acts of the Kyrgyz Republic, and also international treaties which became effective according to the legislation of the Kyrgyz Republic.

2. Restriction of rights and freedoms of man and citizen when ensuring biological safety is possible only in that measure in what it is necessary for the purpose of protection of health of the population, the environment, ensuring defense capability of the country and safety of the state.

Article 2. The basic concepts and determinations used in this Law

In this Law the following concepts are used:

1) biological safety - the condition of security of the person and the environment from impact of pathogenic biological agents and/or products of modern biotechnology provided by realization of system of political, legal, economic, technological, bioprotective and other measures;

2) biological protection - package of measures for ensuring biological safety, aimed at providing control, accounting and protection of the biological materials and/or the equipment, skills and data connected with their processing for prevention of unauthorized access to them, loss, theft, misuse, leakage or release;
