About introduction of amendments to the Law of the Azerbaijan Republic "About prevention of domestic violence"
Millie Majlis of the Azerbaijan Republic, being guided by Items 1 and 14 of part I of article 94 of the Constitution of the Azerbaijan Republic, decides:
Bring in the Law of the Azerbaijan Republic "About prevention of domestic violence" (Collection of the legislation of the Azerbaijan Republic, 2010, No. 10, Article 836 (volume I); 2024, No. 4, article 361, No. 5 (book I), Article 484) following changes:
1. State Article 5.2 in the following edition:
"5.2. If the statement for domestic violence does not contain essential elements of offense, then this application is considered according to the procedure, the stipulated in Clause 9 these Laws.
2. In Item 6.2 of the word "to the relevant organs of the executive authority specified in Item 5" shall be replaced with words to "the relevant organs of the executive authority specified in Item 9.1".
3. State Article 9 in the following edition:
"Article 9. Procedure for consideration of the application about domestic violence if it does not contain essential elements of offense
9.1. The claim upon domestic violence is considered by relevant organ of the executive authority at the place of residence (stay) of the victim taking into account requirements of articles 6.3 and 8 of this Law within 5 (five) days, and in case, the stipulated in Article 11.2 presents of the Law, - within 24 hours from the moment of receipt of the statement.
9.2. In case of need of reclamation of additional materials or studying of additional circumstances for the purpose of conducting check the term of consideration of the claim can be prolonged no more than for 5 (five) days (except for case, the stipulated in Article 11.2 presents of the Law).
9.3. At the request of party injured in judicial session presence of the lawyer and psychologist is provided. If the victim does not know Azerbaijani, the right to use translation service is guaranteed to it.
