About modification of some regulations

The Parliament adopts this organic law.

Art. I. – In article 277-1 of the Code of the Republic of Moldova about offenses No. 218/2008 (repeated publication: The official monitor of the Republic of Moldova, 2017, Art. No. 78-84, 100), with subsequent changes to make the following changes:

part (to state 5) in the following edition:

"(5) Placement and/or distribution of advertizing or the sponsored audiovisual programs for promotion and/or encouragement of gamblings with violation of provisions of the Law on the organization and carrying out gamblings No. 291/2016

attract imposing of penalty on physical persons in the amount of 60 to 120 conventional units, on officials in the amount of 120 to 180 conventional units and on legal entities in the amount of 200 to 300 conventional units.";

in part (6):

to add disposition after words of "charity" with the words "on other conditions, than permitted by the Law on the organization and carrying out gamblings No. 291/2016,";

in the sanction of the word "with deprivation of the right to perform certain activities for a period of 6 months up to one year" to exclude.

Art. II. – In the Law on the organization and carrying out gamblings No. 291/2016 (Official monitor of the Republic of Moldova, 2017, Art. No. 2-8, 3), with subsequent changes, to make the following changes:

1. Add Article 53 with parts (2-3)–(2-8) of the following content:

"(2-3) Provisions of parts (2) and (2-2) do not extend to the organization and participation in sponsor's or charity of the business entities who are engaged in the organization, carrying out and operation of gamblings with low social risk and also beneficiaries of this sponsor's or charity therefore the trademark of the organizer of the gamblings which are the state monopoly can become advertizing.
