About introduction of amendments to the Law on payment for environmental pollution No. 1540/1998

The Parliament adopts this organic law.

Art. I. – In the Law on payment for environmental pollution No. 1540/1998 (Official monitor of the Republic of Moldova, 1998, Art. No. 54-55, 378), with subsequent changes, to make the following changes:

1. In Article 3:

state the concept "packaging for realization" of the following edition:

"packaging for realization – the object developed or designed for filling in outlets and also object disposable which is filled or developed for filling in realization points;";

add Article with the concept "placement in the market" of the following content:

"placement in the market – the first delivery to the market of product for distribution, consumption or use in business activity both for a fee, and is free.".

2. In Article 11:

parts (1) – (To state 3) in the following edition:

"(1) Subjects of the collection regulated by this Article are legal entities irrespective of type of property and form of business and the physical persons performing business activity in any form determined by the legislation namely:

a) producers of the goods specified in appendix 8;

b) importers of the goods specified in appendix 8;

c) the buyers acquiring at the physical persons and legal entities which are in the territory of the Republic of Moldova not having tax relations with its budget system, goods, packaging, and also provided by part (2) the goods packed into packaging;

d) the producers and importers placing in the market the products and goods packed into packaging from materials, stipulated in Item b) parts (2);

e) the producers and importers placing in the market packaging, stipulated in Item c) parts (2).

(2) Types of goods in the course of which use the environment is polluted:

a) the goods specified in appendix 8;
