About modification of the Presidential decree of the Russian Federation of December 24, 2024 No. 1103 "About features of implementation of state registration of the legal entities taking the location in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region, and the rights of such legal entities to real estate"

Bring in the Presidential decree of the Russian Federation of December 24, 2024 No. 1103 "About features of implementation of state registration of the legal entities taking the location in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region, and the rights of such legal entities to real estate" (The Russian Federation Code, 2024, No. 53, the Art. 8657) the following changes:

a) state the name in the following edition:

"About features of implementation of state registration of the legal entities taking the location in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region, and state registration of the rights to real estate";

b) state Item 1 in the following edition:

"1. Determine that:

a) till January 1, 2026 implementation of state registration of the legal entities taking the location (the location of permanent executive body or in case of absence of permanent executive body - other body or person having the right to act on behalf of the legal entity without power of attorney) in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region is forbidden if the founders (participants) of these legal entities and (or) persons having the right without power of attorney to be effective from their name, the foreign persons connected with foreign states which make concerning the Russian Federation of the Russian legal entities and physical persons unfriendly actions are (further - unfriendly foreign states) including if such foreign persons have nationality of these states, the place of their registration, the place of preferential conducting economic activity by them or the place of preferential extraction of profit on activities by them are these states, or persons who are under control of the specified foreign persons, irrespective of the place of their registration (except as specified if the place of their registration is the Russian Federation) or places of preferential conducting economic activity, and state registration of the rights of such legal entities to real estate by them without special permission to its implementation;

b) till January 1, 2028 implementation of state registration of the rights of citizens of unfriendly foreign states to the real estate which is in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region without special permission to its implementation is forbidden.";

c) in Item 2:

word in paragraph one "Item 1 of this Decree" shall be replaced with words "the subitem "an" of Item 1 of this Decree";

in the subitem "an" of the word "in Item 1 of this Decree" shall be replaced with words "in the subitem "an" of Item 1 of this Decree";

in the subitem "b" of the word "in Item 1 of this Decree" shall be replaced with words "in the subitem "an" of Item 1 of this Decree";

d) add with Item 2 (1) the following content:

"2(1). The prohibition established by the subitem "b" of Item 1 of this Decree is applied if documents for state registration of the rights of citizens of unfriendly foreign states to the real estate which is in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region are submitted to territorial authority of Federal Registration Service.";

e) add with Item 2 (2) the following content:

"2(2). Without the special permission provided by the subitem "b" of Item 1 of this Decree state registration of the rights to the real estate which is in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region in the relation is performed:

a) the foreign citizens passing military service under the contract in the Armed Forces of the Russian Federation or military forming;

b) the foreign citizens discharged from military service in the Armed Forces of the Russian Federation or military forming after February 24, 2022 on the bases provided by subitems "b" - "" of Item 1 of article 51 of the Federal Law of March 28, 1998 No. 53-FZ "About conscription and military service";

c) spouses, children (including (dead) adopted (adopted) and parents of the foreign citizens called in subitems "an" and "b" of this Item, including died;

d) spouses, children (including adopted (adopted) and parents of the citizens of the Russian Federation passing (passing) military service under the contract, the citizens of the Russian Federation discharged from military service on the basis provided by the subitem "e" of Item 1 of article 51 of the Federal Law of March 28, 1998 No. 53-FZ "About conscription and military service" except for specified.";

e) in Item 3 of the word "Special Permission Is Issued" shall be replaced with words "The special permissions provided by subitems "an" and "b" of Item 1 of this Decree are issued";

g) item 4 after words of "special permission" to add with words ", Item 1 of this Decree provided by the subitem "an" or "b"";

h) state Item 5 in the following edition:

"5. The special permissions provided by subitems "an" and "b" of Item 1 of this Decree and refusal in their issue are drawn up by decisions of collegiate organ.";

i) state Item 6 in the following edition:

"6. Data on issue of the special permission provided by the subitem "an" or "b" of Item 1 of this Decree or on refusal in its issue within three working days from the date of adoption of this decision by collegiate organ go authorized body of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region or Kherson region to the territorial authority of the Federal Tax Service or Federal Registration Service performing the powers in the territory of appropriate subject of the Russian Federation.";

j) state Item 7 in the following edition:

"7. Legal entities who are called in the subitem "an" of Item 1 of this Decree and to whom it is refused issue of the special permission provided by this subitem are not excluded from the Unified State Register of Legal Entities on condition of reduction of the constituent documents by them in compliance with the legislation of the Russian Federation.";

k) in the subitem "an" of Item 8 of the word "in the case provided by the subitem "b" of Item 2 of this Decree" shall be replaced with words "in the cases provided by the subitem "b" of Item 2 and Item 2 (1) this Decree".

2. This Decree becomes effective from the date of its official publication.
