About measures for further enhancement of system of public administration of the Republic of Kazakhstan
According to the subitem 5) of article 44 of the Constitution of the Republic of Kazakhstan for the purpose of further development of nuclear industry and strengthening of nuclear safety I DECIDE:
1. Form the Agency of the Republic of Kazakhstan on atomic energy (further - the Agency) as state body, directly subordinate and accountable to the President of the Republic of Kazakhstan, with transfer to it of functions and powers of the Department of Energy of the Republic of Kazakhstan in the fields of subsurface use regarding production of uranium, use of atomic energy, ensuring radiation safety of the population, creation and functioning of the Semipalatinsk area of nuclear safety.
2. Determine the Agency the legal successor of the rights and obligations of the Department of Energy of the Republic of Kazakhstan within the transferred functions and powers.
3. Bring in the Presidential decree of the Republic of Kazakhstan of March 11, 2008 No. 552 "About approval of the Regulations on Administration of the President of the Republic of Kazakhstan" the following amendment:
The list of state bodies, directly subordinate and accountable to the President of the Republic of Kazakhstan, approved by the above-named Decree to add with line of the following content:
"Agency of the Republic of Kazakhstan on atomic energy".
4. Administration of the President of the Republic of Kazakhstan:
To submit 1) for consideration to the President of the Republic of Kazakhstan:
together with the Chairman of the Agency projects of regulations on the Agency and its structures;
together with the Government of the Republic of Kazakhstan offers on redistribution of the number of staff from the Department of Energy of the Republic of Kazakhstan and the relevant subordinated organizations in the Agency;
2) to take other measures for implementation of this Decree.
5. To provide to the government of the Republic of Kazakhstan:
