About modification of some legal acts of the Republic of Uzbekistan in connection with enhancement of system of ensuring seismic safety

In recent years in the country system measures for enhancement of the sphere of town planning and ensuring seismic safety of objects of town-planning activities are taken.

At the same time, scales of the damage caused resulting recently in the different countries of the world of strong earthquakes require implementation of number of the address measures aimed at providing seismic safety and increase in seismic stability of buildings and constructions in our country.

In particular, there is need for increase in responsibility of the organizations performing construction and repair of buildings and constructions, strengthening of control of strict observance of the requirements established by the town-planning legislation.

This Law to the Criminal code of the Republic of Uzbekistan makes the changes providing approach of responsibility for violation of rules of issue of the permission to operate of buildings and constructions and their acceptance for operation, construction of facilities without the permission of authorized state bodies in the field of town planning, change and (or) reconstruction of the bearing designs in apartment houses with violation of the law and also designing, reconstruction and construction of buildings and constructions in violation of the approved master plans, site plannings also buildings of settlements. At the same time criminal liability comes after for these offenses perpetrators were already brought to the administrative responsibility. Criminal liability for the violations of the law about town planning which entailed the death of the person or other heavy effects is separately imposed.

Also the possibility of discharge of person who for the first time committed the crime connected with change and (or) reconstruction of the bearing designs in apartment houses with violation of the law is provided and voluntarily eliminated the made change or violations, and also their effects.
