About introduction of amendments to some Laws of Ukraine concerning enhancement of regulation of production and the address of dietary additives, settlement of other questions in the field of health care
The Verkhovna Rada of Ukraine decides:
I. Make changes to such laws of Ukraine:
1. The eighth article 8 of Bases of the legislation of Ukraine about health protection (The sheet of the Verkhovna Rada of Ukraine, 1993, No. 4, of Art. 19 with the following changes) to add part with the offer of the following content: "If by results of the state assessment of medical technologies medicine is recommended to include the central executive body providing forming in the National list of the main medicines approved by the resolution of the Cabinet of Ministers of Ukraine and realizes state policy in the field of health care, makes the decision on inclusion of such medicine in the specified list and submits to the Cabinet of Ministers of Ukraine the draft of the relevant act in time, does not exceed 30 calendar days from the date of promulgation of results of the state assessment of medical technologies of such medicine".
2. In the Law of Ukraine "About advertizing" (Sheets of the Verkhovna Rada of Ukraine, 2004, No. 8, Art. 62 with the following changes):
The paragraph the fifth Item 2 parts one of Article 3-1 to state 1) in the following edition:
"concerning advertizing, sponsorship and placement of product (prodakt-pleysment) of nutritional supplements, foodstuff for the special medical purposes and foodstuff for control of weight";
Part the ninth Article 21 to state 2) in the following edition:
"9. In advertizing of the goods and methods which are not relating to medicines, medical products, methods of prevention, diagnostics, treatment and rehabilitation and also in advertizing of nutritional supplements, foodstuff for the special medical purposes and foodstuff for control of weight it is forbidden to refer to the fact that they have medicinal properties".
