About modification of some legal acts of Ukraine in connection with the Solution of the Constitutional Court of Ukraine of February 14, 2024 No. 1-P(II)/2024 concerning guaranteeing protection of the rights and freedoms of person according to the decision of the European Court of Human Rights

The Verkhovna Rada of Ukraine decides:

1. Make changes to such legal acts of Ukraine:

1) in the Economic Procedure Code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2017, No. 48, the Art. 436):

state Article 321 in the following edition:

"Article 321. Procedure and submission due dates of the statement for review of judgments on again opened or exceptional circumstances

1. The statement for review of the judgment on again opened or exceptional circumstances can be submitted:

1) on the basis determined by Item of 1 part two of article 320 of this Code - participants of case within thirty days from the date of when person learned or could learn about existence of the circumstances which formed the basis for review of the judgment;

2) on the basis determined by Item 2 parts two of article 320 of this Code - participants of case within thirty days from the date of when the sentence (determination) in criminal proceedings entered (took) legal effect;

3) on the basis determined by Item 3 parts two of article 320 of this Code - participants of case within thirty days from the date of the introduction in legal force of the judgment which cancels the judgment which became the basis for adoption of the judgment which is subject to revision;

4) on the basis determined by Item of 1 part three of article 320 of this Code - participants of case within thirty days from the date of official promulgation of the relevant decision of the Constitutional Court of Ukraine;

5) on the basis determined by Item 2 parts three of article 320 of this Code - person on whom the decision is made by the international legal agency which jurisdiction is acknowledged as Ukraine no later than thirty days from the date of when such person learned or could learn about acquisition by this solution of the status final;
