About modification of the Civil code of Ukraine concerning strengthening of protection of the rights of the fair acquirer

The Verkhovna Rada of Ukraine decides:

I. Bring in the Civil code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2003, Art. No. No. 40-44, 356) such changes:

1. To add Article 261 after part seven with new part of the following content:

"8. The course of limitation period according to requirements for reclamation or recognition of the right of rather real estate transferred from the state-owned or utility property to private property, the property right to which is registered in the State register of the corporeal rights to real estate, begins from the date of state registration of the property right of the first acquirer or date of transfer to the first acquirer of real estate concerning which at the time of such transfer need of state registration of the transaction or registration of the property right was not established by the law".

"Article 388. The right of the owner to reclamation of property from the fair acquirer
