About modification of some regulations (increase in responsibility of owners of permissions to connection and improvement of the admission for imbalances of competent producers)
The Parliament adopts this organic law.
Art. I. - In the Law on the electric power No. 107/2016 (Official monitor of the Republic of Moldova, 2016, Art. No. 193-203, 413), with subsequent changes, to make the following changes:
1. Add Article 47 with parts (9) - (13) the following content:
"(9) Owners of permissions to connection to power supply networks of power plants capacity more than 200 kW shall provide to the system operator financial guarantees of proper execution of permissions to connection (for the purposes of this Article - guarantee of proper execution) after receipt of permission to connection according to part (10).
(10) Conditions, requirements, the size, terms of provision and return of guarantees of proper execution, and also cases of use of guarantee of proper execution by the system operator for development of power supply networks are determined by the resolution of the Agency issued for this purpose.
(11) the System operator cancels the issued permissions to connection to power supply networks if owners of these permissions do not represent guarantee of proper execution according to provisions of parts (9) and (10), and informs on it the corresponding owners.
(12) owners of permissions to connection to power supply networks of power plant or power plants on which they received the status of the competent producer, and communities on energy from renewable sources Are exempted from representation of guarantees of proper execution.
(13) the Guarantee of proper execution of permission to connection provided before assignment of the status of the competent producer returns on demand to the owner of the corresponding permission for power plant or power plants on which it received the status of the competent producer.".
