About modification of some regulations (promotion of cogeneration and systems of centralized heat supply)

The Parliament adopts this organic law.

Art. I. - In the Law on public services of municipal services No. 1402/2002 (Official monitor of the Republic of Moldova, 2003, Art. No. 14-17, 49), with subsequent changes, to make the following changes:

1. In Article 2:

in the concept "supply with heat energy" of the word "heat energy;" shall be replaced with words "the heat energy intended for heating and/or preparation of hot water for economic domestic needs and/or for chilling;";

in the concept "the intermediary in calculations" of the word of "the managing director of housing stock" shall be replaced with words "the administrator of the association/managing director of condominium";

exclude the concept "managing director of housing stock".

2. Add Article 3 with parts (6) and (7) the following content:

"(6) Hot water for economic domestic needs is received as a result of heating of the drinking water delivered by the operator of public water supply system and the sewerage according to provisions of the Law on public service of water supply and the sewerage No. 303/2013.

(7) Owners of the license for activities for delivery/provision of public service of water supply and/or the sewerage bear responsibility for quality of the provided service / the delivered product according to provisions of the Law on public service of water supply and the sewerage No. 303/2013, and owners of the license for production, distribution or delivery of heat energy bear responsibility for quality of the provided service / the delivered product according to provisions of the Law on heat energy and promotion of cogeneration No. 92/2014.".

3. Item g) parts (Article 15 to state 1) in the following edition:

"g) consider the claims of consumers/residents to the administrator of the association/managing director of condominium and intermediaries in calculations concerning the mediated services, to perform mediation in the conflicts between the operator and the consumer.".

4. Part (Article 21 after words of "water supply and the sewerage" to add 2) with words ", heat energy".

5. In part (Article 25 of the word "with managing directors of housing stock." shall be replaced with words 6) "with administrators associations/managing directors of condominium.", the words "on the managing director of housing stock" shall be replaced with words "on the administrator the association/managing director of condominium,".

Art. II. - In the Law on local public authority No. 436/2006 (Official monitor of the Republic of Moldova, 2007, Art. No. 32-35, 116), with subsequent changes, to make the following changes:

1. Part (Article 14 to add 2) with the Item p-2) of the following content:

"p-2) according to the law approves according to the offer of primar unitary zones of heat supply as a part of administrative and territorial unit;".

2. Part (Article 29 to add 1) with the Items s-1) and s-2) of the following content:

"s-1) offers according to the law on approval to local/local government board the unitary zones of heat supply as a part of administrative and territorial unit determined by heat power units as a result of development of feasibility statements and issue on them the positive conclusions the National center for steady energy. In feasibility statements documents of regional and local development, and also the local integrated plans for energy and climate on condition of their approval of local public authority by bodies are considered;

s-2) in coordination with operators of electrical distribution systems, operators of systems of distribution of natural gas, operators of services of water supply and the sewerage, the distributor of heat energy participates in development and approval of projects of distribution networks of the electric power, natural gas, water supply and the sewerage, thermal networks according to town-planning documentation after approval of unitary zones by local/local government board.".

Art. III. - In the Law on heat energy and promotion of cogeneration No. 92/2014 (Official monitor of the Republic of Moldova, 2014, Art. No. 178-184, 415), with subsequent changes, to make the following changes:

1. The change provided by this Item concerns only the text in Romanian.

2. In Article 4:

in Item d) shall be replaced with words the words "for economic needs;" "for economic domestic needs;";

Item f) to state in the following edition:

"f) consumer protection;".

3. In Article 5:

exclude the concept "managing director of housing stock";

state the concepts "hot water for economic needs" and "consumer" of the following edition:

"hot water for economic domestic needs - the hot water used in the economic and household or sanitary and hygienic purposes received as a result of heating of drinking water with use of heat energy;";

"the consumer - the physical person or legal entity receiving heat energy as under the agreement, and actually for economic domestic needs or other purposes;";

after the concept "consumer" to add Article with concepts of the following content:

"the residential customer - the physical person using heat energy for the economic domestic needs which are not connected with business or professional activity in unit of condominium / on the real estate unit of residential appointment;

not residential customer - the physical person or legal entity using heat energy for the purpose of, other than economic domestic needs in unit of condominium / on the uninhabited real estate unit;

the consumer of the mediated services - the owner of unit of condominium and its full age owner in whose actual possession some time is this unit to which the supplier of heat energy provides the mediated service;

the distributor - the heat power unit performing activities for distribution of heat energy according to this law;";

state the concept "global efficiency" of the following edition:

"global efficiency - ratio of the amount of the made electrical and heat energy and amount of energy of the fuel spent for production of electrical and heat energy in the course of cogeneration;";

in the concept "heat energy" of the word "accepting energy;" shall be replaced with words "accepting the energy intended for heating, preparation of hot water for economic domestic needs and/or for chilling;";

after the concept "useful heat energy" to add Article with concept of the following content:

"outsourcing of service or work - transfer of the license by the owner to the third party of service or work which according to this law and according to the licensing conditions provided by this law it shall execute, not providing concession of this license to the third party;";

after the concept "supplier" to add Article with concept of the following content:

"burning / joint burning of waste in the energy purposes - process of burning of waste on special installations for the purpose of production of heat energy and/or other forms of energy in the cogeneration mode;";

state the concept "differentiating Item" of the following edition:

"differentiating Item - the place of differentiation based on the property right of installations on use of heat energy of the consumer from installations of the distributor or the place which is established by the agreement of the parties in case of carrying out by the progressman on reconstruction of collective system of heat supply, and also the place of differentiation based on the property right of installations of heat power units;";

after the concept "differentiating Item" to add Article with concepts of the following content:

"accounting point - installation site of the measuring equipment by means of which the amount of heat energy for the purposes of commercial accounting is measured;

connection point - the place of connection/accession on circumstances of the heatstation or installation for consumption of heat energy to the installations which are in property or in management of the distributor;

thermal branch / input - connecting installation between distribution network and installation for use of heat energy of the consumer;";

after the concept "ratio between electrical and heat energy" to add Article with concepts of the following content:

"distribution of amounts of consumptions/costs - set of the actions and actions performed on the basis of the meter readings and data provided by the administrator to associations/managing directors of condominium for the purpose of distribution on each unit of condominium of amounts of consumption of the heat energy delivered to consumers including for preparation of hot water for economic domestic needs in the apartment house connected to system of centralized heat supply;

thermal network - set of pipelines, pumping units, central heat distribution stations, the individual thermal Items located below differentiation Item from the heatstation, thermal power plants which serve for distribution of heat energy before the installations of the consumer using heat energy;

the mediated delivery service of heat energy (further also - the mediated service) - service of heat supply which owners and owners of units in condominium, but which depending on specific provision of condominium for the technical or legal reasons is provided by condominium indirectly based on the agreement signed between the administrator the association/managing director of condominium (the intermediary of provision of services) and the supplier and concerning which the individual agreement cannot be signed by owners or owners of units or for which individual accounts cannot be charged by it use or can use;";
