About change of resolutions of Council of Ministers of the Republic of Belarus of September 6, 2006 No. 1149 and of September 18, 2020 No. 541

1. Make changes to the following resolutions of Council of Ministers of the Republic of Belarus:

1.1. in the resolution of Council of Ministers of the Republic of Belarus of September 6, 2006 No. 1149 "About attendance allowance for the disabled person of the I group or person who reached 80-year age":

to state preamble and Item 1 in the following edition:

"Based on part two of item 4 of article 13 of the Law of the Republic of Belarus of December 13, 2023 "About change of the laws concerning social servicing and social payments" the Council of Ministers of the Republic of Belarus DECIDES: No. 318-Z

1. Approve Regulations on procedure for appointment and allowance payment on care of the disabled person of the I group or person which reached 80-year age it (is applied).";

To be reworded as follows the regulations on procedure for appointment and allowance payment on care of the disabled person of the I group or person which reached 80-year age approved by this resolution it (is applied);

1.2. "About the documents requested when implementing ministerial procedures" to state the column "The Documents and (or) Data Requested by Local Executive and Administrative Organs" of Item 49 of appendix to the resolution of Council of Ministers of the Republic of Belarus of September 18, 2020 to No. 541 in the following edition:

"copies of the conclusion of medico-rehabilitation commission of experts, the individual program of rehabilitation, the disabled person's abilitation containing the information about group of disability and needs of the disabled person of the I group in permanent care – from the organization of health care (in the absence of the specified documents (data) in management (department) of work, employment and social protection of city, district executive committee, management (department) of social protection of local administration of the area in the city (further – body for work, employment and social protection) at the place of residence of the disabled person of the I group)

the data confirming lack of registration of the citizen who addressed for implementation of ministerial procedure (further in this Item – the interested person), as the unemployed, about not passing by the interested person of professional training, retraining, advanced training or development of contents of the educational program of the training rates in the direction of bodies for work, employment and social protection – from body for work, employment and social protection (in the absence of the specified data in body for work, employment and social protection for the residence of the disabled person of the I group or person which reached 80-year age)

data on non receipt by the interested person of monthly insurance payment according to the legislation on compulsory insurance from labor accidents and occupational diseases – from separate divisions of the Belarusian republican unitary insurance enterprise Belgosstrakh

data on non receipt by the interested person of monthly monetary pay according to the legislation on public service – from body for work, employment and social protection for the residence of the interested person (in the absence of the specified data in body for work, employment and social protection for the residence of the disabled person of the I group or person which reached 80-year age)

data on non receipt by the interested person of national pension, including according to international treaties of the Republic of Belarus in the field of social (pension) security, – from body for work, employment and social protection, Social Security Fund of the population of the Ministry of Labour and Social Protection, pension bodies of the Ministry of Defence, the Ministry of Internal Affairs, the Ministry of Emergency Situations, Committee for State Security (in the absence of the specified data in body for work, employment and social protection for the residence of the disabled person of the I group or person which reached 80-year age)

the data, confirmatory that the interested person does not work according to the employment contract, does not perform work on the civil agreement which subject is performance of works, rendering services and creation of intellectual property items, – from the state information resource "The Register of Individual Personal Accounts of Insured Persons in System of the Individual (Personified) Accounting in System of the National Social Insurance" (by means of the nation-wide automated information system

data on suspension of operations by person registered as the individual entrepreneur in connection with child care before achievement of age of 3 years by it (concerning mother, the father, the son, the daughter, the spouse or the spouse, the guardian (custodian) of the disabled person of the I group or person which reached 80-year age) – from bodies of Social Security Fund of the population of the Ministry of Labour and Social Protection

data, confirmatory that the disabled person of the I group or person who reached 80-year age are not receiver of rent according to the contract of the perpetual maintenance with dependence, – from the single state register of real estate, the rights to it and transactions with it (by means of the nation-wide automated information system)

data on availability (absence) at the interested person of the outstanding or not removed criminal record for the intentional less serious crimes provided in Chapters 19-22 and 24 of the Criminal code of the Republic of Belarus and also for heavy or especially serious crimes – from single national bank of data on offenses".

2. This resolution becomes effective since July 1, 2024.
