About increase in role of employers in the field of external labor migration

For the purpose of enhancement of state policy in the field of external labor migration, creation of safe conditions for implementation of labor activity by workers-immigrantami*:

* For the purposes of this Decree workers immigrants are understood as the foreign citizens or stateless persons which do not have the permissions to permanent residence in the Republic of Belarus driving (driven) to the Republic of Belarus for implementation of labor activity according to the employment contract at the employer or performing such activities in the Republic of Belarus irrespective of receipt by the employer of special permission to the right of occupation labor activity in the Republic of Belarus, except for citizens of state members of the Eurasian Economic Union.

1. Determine that the employers attracting workers immigrants to implementation of labor activity in the Republic of Belarus:

1.1. the occupations which got special permission to the right labor activity in the Republic of Belarus concerning workers immigrants, shall sign the employment contract with them no later than 30 calendar days from the date of their entry into the Republic of Belarus, and for driven before receipt of special permission - within 30 calendar days from the date of its obtaining;

1.2. determine in local legal acts of persons responsible for control of labor activity and conditions of stay (accommodation) of workers immigrants;

1.3. provide at least once during action of the employment contract visit of workers immigrants in the place of temporary stay (accommodation) for assessment:

the actual accommodation in the place of temporary stay (accommodation) determined according to the legislation;

compliance of conditions of accommodation to sanitary standards and rules, hygienic standard rates and other requirements, obligatory for accomplishment, imposed to premises and also observance of instructions for use by premises and their content (in case of accommodation of workers immigrants in premises).
