About introduction of amendments to the Law of the Kyrgyz Republic "About reference tribunals in the Kyrgyz Republic"

Article 1.

Bring in the Law of the Kyrgyz Republic "About reference tribunals in the Kyrgyz Republic" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2002, No. 10, the Art. 436) the following changes:

Article 28 to state 1) in the following edition:

"Article 28. Finality of the decision of reference tribunal

1. The decision of reference tribunal is final and is not subject to contest on the substance of dispute, except as specified, provided by this Article. The parties shall perform the decision of reference tribunal according to the procedure and the terms established in the decision.

2. The decision of reference tribunal can be disputed in cases if the party of dispute on which the decision of reference tribunal is passed are the state body, local government body, the public or local government office and the company, other legal entities with the state or municipal share.

The basis for filing of application about cancellation of the decision of reference tribunal are the cases provided by subitems 1-6 of Item 3 of article 36-1 of this Law.";

To add 2) with Article 36-1 of the following content:

"Article 36-1. Procedure for contest of the decision of reference tribunal

1. The decision of reference tribunal can be disputed by the parties of arbitration specified in Item 2 of article 28 of this Law concerning which rights and obligations the decision of reference tribunal, within 30 days from the date of decision is passed.

2. The application for cancellation of the decision of reference tribunal is submitted to district or city court in the location of reference tribunal. Filing of application about cancellation of the decision of reference tribunal stops execution of the decision of reference tribunal.
