This Law determines legal, organizational basis and the principles of realtor activities in the Republic of Belarus, and also governs the relations in the field of realtor activities.
For the purposes of this Law the following main terms and their determinations are used:
realtor activities - the activities of the realtor organization or territorial organization for state registration of real estate, the rights to it and transactions with it on rendering realtor services directed to assistance in case of the conclusion, execution, the termination of construction agreements (including equity), purchase and sale, exchange, lease, hiring, other transactions with real estate units, the rights to them (except for the organizations and tenderings);
realtor services - the services rendered by the realtor organization or the territorial organization for state registration of real estate, the rights to it and transactions with it to the consumer intending to make the transaction with the real estate unit;
the realtor organization - the commercial organization performing realtor activities in the presence of the license for implementation of realtor activities (further - the license);
the realtor - the physical person having the certificate on certification of the realtor, being the employee of the realtor organization or territorial organization for state registration of real estate, the rights to him and transactions with it, rendering realtor services on behalf of these organizations and meeting other requirements of this Law and other acts of the legislation on realtor activities;
the consumer - legal entity or physical person to which the realtor organization renders realtor services.
1. The relations in the field of realtor activities are governed by the civil legislation, the legislation on realtor activities, on licensing, the international treaties of the Republic of Belarus and other international legal acts containing obligations of the Republic of Belarus.
2. The legislation on realtor activities is based on the Constitution of the Republic of Belarus and consists of this Law and other acts of the legislation.
3. If the international treaty of the Republic of Belarus establishes other rules, than those which are provided by this Law then are applied rules of the international treaty.
This Law governs the relations in the field of realtor activities.
Realtor activities are based on the principles:
legality;
conscientiousness;
professionalism;
priority of consumer interests;
observance of Rules of professional ethics of the realtor by employees of the realtor organization;
confidentiality of information;
proportionalities of cost of realtor services to their amount, complexity and quality.
State regulation in the field of realtor activities is performed by the President of the Republic of Belarus, Council of Ministers of the Republic of Belarus, the Ministry of Justice.
1. The president of the Republic of Belarus in the field of realtor activities determines single state policy and performs other powers according to the Constitution of the Republic of Belarus, this Law and other legal acts.
2. Features of legal regulation of the relations regulated by this Law can be established by the president of the Republic of Belarus.
Council of Ministers of the Republic of Belarus in the field of realtor activities:
provides realization of single state policy;
regulates rates for the realtor services concerning premises, the parcels of land, dachas, garden lodges, garages, parking places rendered to physical persons, except for individual entrepreneurs including for realtor services in assistance in sale of the called real estate units which payment is established in percentage terms from the project cost of real estate specified in the purchase and sale agreement;
determines payment procedure of realtor services;
performs other powers according to the Constitution of the Republic of Belarus, this Law and other legal acts.
1. The Ministry of Justice in the field of realtor activities:
performs licensing of realtor activities, including creates the commission on questions of licensing of realtor activities, determines procedure for its activities;
holds testing certification for persons applying for receipt of the certificate on certification of the realtor (further - testing certification), and grants the certificate on certification of the realtor;
accepts according to the competence regulatory legal acts concerning realtor activities, including:
Rules of professional ethics of the realtor;
The regulations on the head and the deputy manager of the realtor organization, establish requirements to them;
procedure for holding testing certification;
procedure for carrying out certification of realtors;
the list of the documents submitted by the realtor organizations to the Ministry of Justice when implementing realtor activities, their content and terms of representation;
form of the form of the identification plastic card which is the form of the document with certain degree of protection, procedure for issue, accounting, replacement, suspension of action, use, storage of identification plastic cards and their return to the manufacturer for destruction;
form of submission of the departmental reporting by the realtor organizations;
