About modification of the Budget code of Ukraine concerning implementation of the Agreement between the Government of Ukraine and the Government of the United States of America about creation of the American-Ukrainian investment fund of recovery

The Verkhovna Rada of Ukraine decides:

I. Bring in the Budget code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2010, Art. No. 50-51, 572) such changes:

1. Add Article 2 with part two of the following content:

"2. Determine that for the purposes of of this Code:

the term "Assets of Natural Resources" is used in the sense determined for the term "The Assets Relating to Natural Resources" in Appendix A to the Agreement between the government of Ukraine and the Government of the United States of America on creation of the American-Ukrainian investment fund of the recovery ratified by the Law of Ukraine of May 8, 2025 No. 4417-IX (further - the Agreement on fund of recovery);

to the income connected with Assets of natural resources (determined in Items 5, 5-1, 28 and 55 part two and Items 13-14-13-16 of part three of Article 29, Items 4, 4-2 both 4-3 parts one of Article 64, items 4 and 4-1 part one of Article 66 and Item 4-2 of part one of Article of 71 of this Code), income gained only from or in connection with issue of new licenses or special permissions after entry into force for Ukraine of the Agreement on fund of recovery, but not earlier than day of entry into force of the Agreement between Corporation of the United States of America on financing of the international development and the Agency concerning support of public-private partnership about creation of the American-Ukrainian investment fund of recovery in the form of limited partnership (further - the Agreement on limited partnership), and/or income gained from operation of licenses or special permissions belongs issued before entry into force for Ukraine by the specified agreements, but which were not operated in the industrial purposes as of the date of entry into force of the specified agreements".
