About modification of some regulations (effective counteraction of electoral corruption and aspects connected with this phenomenon)

The Parliament adopts this organic law.

Art. I. - Part (1) article 9 of the Law on identification documents of national passport system No. 273/1994 (1995, No. 9, the Art. 89), with subsequent changes, to add the official monitor of the Republic of Moldova with Items n) and o) the following content:

"n) collection of copies of the identification documents, except as specified, which are directly provided by the law or separate cases in the specific situations which are not assuming frequent and/or mass collection of copies of identification documents;

o) placement on the global Internet of copies of the identification documents or data containing the state identification number of physical person, series and number of the relevant document.".

Art. II. - In the Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, Art. No. 72-74, 195), with subsequent changes to make the following changes:

1. In part (1) articles 55 of figure "181-1," to exclude, add part after figures "314," with words "part (1) Articles 324,".

2. In part (Article 134-18 of the word "and extremism" to exclude 1).

3. To add Chapter XIII of the General part with Article 134-26 of the following content:

"Article 134-26. Extremist organizations and materials of extremist nature

The extremist organization or materials of extremist nature are understood as the organization or materials determined by those in the Law on counteraction of extremist activities No. 54/2003.".

4. In Article 181-1:

in part (1):

in disposition the word "Offer" shall be replaced with words "The promise, the offer";

state the sanction in the following edition:

"are punished by imprisonment for a period of 2 up to 6 years with imposing of penalty in the amount of 750 to 1150 conventional units and with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of up to 5 years, and in case of the legal entity - penalty in the amount of 6000 to 8000 conventional units with deprivation of the right to be engaged in certain activities or with liquidation of the legal entity.";

the sanction of part (1-1) to state in the following edition:

"it is punished by imprisonment for a period of 3 up to 7 years with imposing of penalty in the amount of 850 to 1350 conventional units and with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of 2 up to 5 years, and in case of the legal entity - penalty in the amount of 9000 to 13 000 conventional units with deprivation of the right to be engaged in certain activities or with liquidation of the legal entity.";

add Article with parts (1-2) and (1-3) following contents:

"(1-2) Actions provided by parts (1) or (1-1), committed:

a) two or more persons;

b) concerning two or more persons;

c) c use of financial resources from public funds,

are punished by imprisonment for a period of 4 up to 8 years with imposing of penalty in the amount of 1350 to 1850 conventional units and with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of 2 up to 7 years, and in case of the legal entity - penalty in the amount of 12 000 to 16 000 conventional units with deprivation of the right to be engaged in certain activities or with liquidation of the legal entity.

(1-3) Actions provided by parts (1) - (1-2), committed:

a) for the benefit of organized criminal group or the criminal organization;

b) person who knew or owed know the money that promised, offered or provided, property, services or other benefits arrived from organized criminal group, the criminal organization;

c) person who knew or owed know the money that promised, offered or provided, property, services or other benefits arrived from foreign state, the foreign organization, unconstitutional education or their representatives,

are punished by imprisonment for a period of 7 up to 15 years with imposing of penalty in the amount of 1850 to 2350 conventional units and with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of 5 up to 10 years, and in case of the legal entity - penalty in the amount of 16 000 to 20 000 conventional units with deprivation of the right to be engaged in certain activities or with liquidation of the legal entity.".

5. In Article 181-3:

consider single part part (1);

the sanction of part (to state 1) in the following edition:

"it is punished by imprisonment for a period of 3 up to 6 years with imposing of penalty in the amount of 850 to 1350 conventional units and with deprivation of the right to hold certain positions or to be engaged in certain activities for the term of 2 up to 7 years, and in case of the legal entity - penalty in the amount of 9000 to 13 000 conventional units with deprivation of the right to be engaged in certain activities or with liquidation of the legal entity.";

add Article with part (2) the following content:

"(2) the Actions provided by part (1), committed:

a) for the benefit of organized criminal group or the criminal organization;

b) person who knew or owed know the money that promised, offered or provided, property, services or other benefits arrived from organized criminal group, the criminal organization;

c) person who knew or owed know the money that promised, offered or provided, property, services or other benefits arrived from foreign state, the foreign organization, unconstitutional education or their representatives,

are punished by imprisonment for a period of 7 up to 15 years with imposing of penalty in the amount of 1850 to 2350 conventional units and with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of 5 up to 10 years, and in case of the legal entity - penalty in the amount of 16 000 to 20 000 conventional units with deprivation of the right to be engaged in certain activities or with liquidation of the legal entity.".

6. In Article 182:

the sanction of part (to state 2) in the following edition:

"are punished by imprisonment for a period of 3 up to 7 years with imposing of penalty in the amount of 850 to 1150 conventional units and with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of 2 up to 7 years.";

add Article with part (3) the following content:

"(3) the Actions provided by part (1) or (2), made for the benefit of organized criminal group or the criminal organization,

are punished by imprisonment for a period of 5 up to 10 years with imposing of penalty in the amount of 1850 to 2350 conventional units and with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of 2 up to 7 years.".

7. The sanction of part (Article 264 to add 4) with the words "with cancellation of the right of control of vehicles".

8. Add the code with Articles 346-1 and 346-2 of the following content:

"Article 346-1. Management of the extremist organization or organization of its activities or participation in it

(1) the Management of the extremist organization or the organization in any form of its activities
