About modification of some regulations (release in certain cases from payment of the state fee and the stamp tax of victims of violence in family, and also execution of the Resolution of the Constitutional court No. 20/2024)

The Parliament adopts this organic law.

Art. I. – In the Code of civil procedure of the Republic of Moldova No. 225/2003 (repeated publication: The official monitor of the Republic of Moldova, 2018, Art. No. 285-294, 436), with subsequent changes to make the following changes:

1. Part (Article 84 to state 4) in the following edition:

"(4) the Sum of money paid as the stamp tax is not subject to return, except as specified, provided by the Law on the state fee No. 213/2023.".

2. Parts (1) and (Article 85 to state 4) in the following edition:

"(1) Release from the state fee and/or the stamp tax is stipulated in Item 1 appendices 2 to the Law on the state fee No. 213/2023 and it is applied according to the procedure, provided by part (4) this Article.";

"(4) Taking into account financial position of physical person or legal entity and the provided with respect thereto proofs the judge (degree of jurisdiction) exempts it from payment of the state fee completely or its parts and/or from payment of the stamp tax, both in the first instance, and in the course of appeal.".

3. In Article 86:
