About modification of the Criminal code of the Kyrgyz Republic

Article 1.

Bring in the Criminal code of the Kyrgyz Republic (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following change:

add with Article 209-1 of the following content:

"Article 209-1. Intentional transfer or sale to the third parties of electronic instruments of payment, purse of virtual asset and SIM card

1. Intentional transfer or sale by the client of the bank and the other person providing banking services, the service provider of virtual assets, the subscriber of the operator of telecommunication to the third parties of electronic instruments of payment, purse of virtual asset and the SIM card with provision of access and management of them on specifying and for the benefit of the third parties for the purpose of making of the wrongful acts which entailed damnification in insignificant size -

it is punished by penalty from 200 to 500 settlement indicators.

2. Same act, committed:

1) with damnification in considerable size;

2) group of persons;

3) group of persons by previous concert, -

it is punished by corrective works for a period of two months up to one year or penalty from 500 to 1000 settlement indicators, or imprisonment for a period of up to three years.

3. The acts provided by parts 1 or 2 of this Article committed:

1) with damnification in large size;

2) person with use of the official position, -

are punished by penalty from 1000 to 2000 settlement indicators or imprisonment for a period of three up to five years.

4. The acts provided by parts 1, 2 or 3 these Articles committed:

1) with damnification in especially large size;

2) organized group;

3) as a part of criminal society, -

are punished by imprisonment for a period of five up to ten years with confiscation of property, with deprivation of the right to hold certain positions or to be engaged in certain activities for up to three years.
