About modification of some regulations (provision of partially free legal aid guaranteed by the state)

The Parliament adopts this organic law.

Art. I. - In the Code of penal procedure of the Republic of Moldova No. 122/2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes to make the following changes:

1. In Article 69:

in Item 10) parts (the word "considers" 1), to replace with the word "states";

in the prolog of part (the words "The Degree of Jurisdiction States" shall be replaced with words 2) "In case, stipulated in Item 10) parts (1), the degree of jurisdiction states".

2. In part (4) Article 70 of the word "If Interests of Justice Require Participation of the Defender in Criminal Procedure", shall be replaced with words "If participation of the defender in criminal procedure is obligatory according to part (1) Articles 69,".

3. Add Article 344-1 with part (2-1) following of content:

"(2-1) If one of the parties refers to lack of the means sufficient for payment of mediativny services, the degree of jurisdiction upon the demand of the relevant party takes out the determination provided by part (2), without specifying of surname of mediator and sends it to competent territorial office of National council on the legal aid guaranteed by the state for provision of the mediativny services guaranteed by the state. If the relevant territorial office refuses to provide the mediativny services guaranteed by the state, the degree of jurisdiction upon the demand of the parties appoints mediator which will carry out the procedure of mediation which is not guaranteed by the state.".

Art. II. - In the Law on the legal aid guaranteed by the state, No. 198/2007 (Official monitor of the Republic of Moldova, 2007, Art. No. 157-160, 614), with subsequent changes, to make the following changes:

1. In Item and) parts (1) Article 19 of the word "when that is required by interests of justice", to exclude.
