To add Chapter I.1 with Article 11.11 of the following content:

"Article 11.11. Determination of categories of lands and types of the permitted use of the parcels of land in case of formation of the parcels of land

1. Category of lands and types of the permitted use of the formed parcels of land the category of lands and types of the permitted use of the parcels of land from which in case of the Section, consolidation, redistribution or apportionment the parcels of land are formed, except as specified, established by this Code, other Federal Laws are recognized.

2. Types of the permitted use of the formed and changeable parcels of land the types of the permitted use of such parcels of land provided by the boundary-setting plan are recognized the following cases:

1) if such parcels of land are formed of the parcels of land or the parcels of land provided for complex development of the territory or located in borders of the territory concerning which the agreement on complex development of the territory is signed and (or) the decision on complex development of the territory is made, and such parcels of land are formed of lands, and also the parcels of land which are not provided to citizens or legal entities or if such education is performed by the owner of the parcel of land or the parcels of land performing complex development of the territory;

2) if such parcels of land are formed of the parcel of land provided to gardening or gardening non-commercial partnership;

3) if such parcels of land are formed of the parcel of land provided for placement of garages in borders of the territory of garage appointment;

4) if according to Item 5 of Article 14.2 of this Code types of the permitted use of such parcels of land are established by documentation on the layout of the territory (the site planning and (or) the boundary-setting plan) and such parcels of land are formed of the lands and (or) the parcels of land which are not provided to citizens or legal entities.

3. Types of the permitted use of the parcels of land formed of the lands and (or) the parcels of land which are in the state-owned or municipal property for the purpose of holding auctions for sale of such parcels of land, auctions on the right of the conclusion of lease agreements of such parcels of land or provision of such parcels of land without tendering are determined by public authorities and local government bodies, stipulated in Article 39.2 of this Code, by the rules established by Items 12 and 13 of Article 14.4 of this Code.

4. Concerning the parcel of land intended for implementation of use of natural resources, the type of the permitted use providing possibility of implementation of use of natural resources is established based on the license to use by subsoil or based on the project documentation on implementation of use of natural resources, except as specified, if such activities do not correspond to purpose of the parcel of land or if according to this Code, other Federal Laws establish prohibition on implementation of use of natural resources in borders of certain zones, lands, the territories. Action of provisions of this Item extends both to the educated parcel of land, and to the parcel of land which should be formed.

5. Type or types of the permitted use of the parcel of land formed of the parcel of land, the type or types of the permitted use of which do not correspond to the types of the permitted use of the parcels of land established by town-planning regulations, the forestry and landscape regulations, regulations on especially protected natural territory (further - regulations of use of lands), the type or types either the type or types of the permitted use of the parcels of land established by regulations of use of lands resolved uses of the initial parcel of land on condition of observance of provisions of Article 14.4 of this Code are recognized at the choice of the owner of the parcel of land.
