About modification of separate legal acts of the Russian Federation and about system of cost recovery of the property considered on individual investment accounts

Article 1

Bring in the Federal Law of April 22, 1996 No. 39-FZ "About the security market" (The Russian Federation Code, 1996, No. 17, Art. 1918; 2018, No. 53, Art. 8440; 2019, No. 31, Art. 4418; 2020, No. 31, Art. 5065; 2024, No. 33, Art. 4983) following changes:

Item 1 of Article 2 to add 1) with the subitem of 31 following contents:

"31) system of cost recovery of property which is considered on individual investment accounts, - the interconnected actions of legal, financial and organizational nature for implementation of compensation payments for benefit of physical persons - clients of persons performing opening and maintaining individual investment accounts, according to the procedure and on conditions which are determined by this Federal Law.";

To add 2) with Articles 10.2-1-1 - 10.2-1-3 following of content:

"Article 10.2-1-1. Cost recovery of property of physical persons which is considered on individual investment accounts

1. Physical persons have the right to cost recovery of property which is considered on individual investment accounts, by compensation payment according to the procedure and the size which are determined by this Article, in case of simultaneous observance of the following conditions:

1) before the expiration of six months from acceptance date by Arbitration Court of the decision on recognition of person performing opening and maintaining individual investment accounts by the bankrupt and about opening of bankruptcy proceedings were not satisfied in complete size in accordance with the legislation of the Russian Federation about insolvency (bankruptcy) of the requirement of his client - physical person about transfer of the property belonging to it which is considered on the individual investment account;
