About construction of facilities of cellular communication

For the purpose of development of modern infrastructure of networks of telecommunication, implementation of new information and communication technologies, improvement of quality and availability of the rendered services of telecommunication:

1. Determine that:

1.1. availability of objects of cellular mobile telecommunication (including means and lines of telecommunication) (further - objects of cellular communication), the engineering and transport infrastructure necessary for ensuring their functioning (further - necessary infrastructure), and also development of technology of cellular mobile telecommunication is provided with operators of cellular mobile telecommunication at the same time with construction of apartment houses, entertainment and shopping centers, sports complexes;

1.2. the parcels of land for construction and servicing of objects of cellular communication and necessary infrastructure are provided to operators of cellular mobile telecommunication in lease for a period of 99 years without holding the auction and without collection of payment for the lease right, in permanent and (or) temporary use without their inclusion in lists of the free (unoccupied) parcels of land and lists of the parcels of land for implementation of investment projects.

The parcels of land for construction and servicing of objects of cellular communication and necessary infrastructure within settlements, and also in the territories of gardening partnerships (the lands used by citizens for collective gardening) are provided without functional zoning of the territories;

1.3. registration of materials on withdrawal of the parcels of land provided according to subitem 1.2 of this Item is made based on the statement of the operator of cellular mobile telecommunication along with performance of works on development of the project documentation and construction of facilities of cellular communication and necessary infrastructure. At the same time occupation and use of the parcel of land without document certifying the right to it are not unauthorized occupation of the parcel of land.
