About modification and amendments in some resolutions of the Plenum of the Supreme Court of the Republic of Uzbekistan and the Plenum of the Supreme Economic Court of the Republic of Uzbekistan

I. Make changes and additions to the following resolutions of the Plenum of the Supreme Court on general questions:

1. In the resolution of the Plenum of the Supreme Court of the Republic of Uzbekistan and the Plenum of the Supreme Economic Court of the Republic of Uzbekistan of December 20, 1996 No. 1/60 "About judicial authority":

to state paragraph two of Item 2 in the following edition:

"Courts should mean that according to article 16 of the Constitution of the Republic of Uzbekistan any law or other regulatory legal act cannot contradict the principles and regulations of the Constitution";

state Item 13 in the following edition:

"13. Courts by hearing of cases and materials shall observe strictly the principle, stipulated in Article 65 Constitutions of the Republic of Uzbekistan according to which the state creates conditions for development of the market relations and fair competition, guarantees freedom of economic activity, entrepreneurship and work taking into account priority of the rights of consumers. It must be kept in mind that in the Republic of Uzbekistan equality and legal protection of all patterns of ownership are provided, the private property is inviolable. Therefore by hearing of cases courts shall find out how state bodies and officials protect the rights of the owner and observe them, to react properly to the facts of unreasonable checks, audits, etc. and to take measures for damages recovery, caused to the owner as a result of such illegal actions, from guilty officials".

2. The resolution of the Plenum of the Supreme Court of the Republic of Uzbekistan of February 21, 2020 No. 04 "About ensuring openness of legal proceedings and right to be informed about activity of the courts":

in item 4 of the word "judges are independent and submit only to the law" shall be replaced with words "judges are independent and submit only to the Constitution and the law";

state Item 11 in the following edition:

"11. Trial of case in the closed judicial session for the purpose of preserving the state secrets, trade secret and other secret protected by the law is allowed only in the presence in data which according to the Law of the Republic of Uzbekistan "About protection of the state secrets" and other legal acts are carried to the state secrets, trade secret and other secret protected by the law";

3. The resolution of the Plenum of the Supreme Court of the Republic of Uzbekistan of July 3, 2020 No. 11 "About judicial protection of the rights and legitimate interests of physical persons and legal entities":

in paragraph three of Item 5 of the word "writ of appeal" shall be replaced with words "appeal, the writ of appeal and the claim in auditing procedure".

II. Make changes and additions to the following resolutions of the Plenum of the Supreme Court on joint questions:

1. The resolution of the Plenum of the Supreme Court of the Republic of Uzbekistan and the Plenum of the Supreme Economic Court of the Republic of Uzbekistan of December 22, 2006 No. 13/150 "About some questions of application of the regulations of the civil legislation on ensuring obligation fulfillment following from credit agreements":

add Item 10 with the paragraph the tenth the following content:

2.
