About modification of the Presidential decree of the Russian Federation of October 7, 2022 No. 723 "About application of additional special economic measures in the fuel and energy sphere in connection with unfriendly actions of some foreign states and the international organizations"

a) to state the subitem "zh" of Item 1 in the following edition:

"g) the share in the authorized capital of society, the decision on which transfer is made by the Government of the Russian Federation, is without delay transferred to the foreign party of consortium on which according to the paragraph third the subitem "e" of this Item makes the decision on such transfer, in case of confirmation of observance by this party of consortium of all conditions determined by Item 1 (1) this Decree, and management of the Government of the Russian Federation of this share stops;";

b) add with Item 1 (1) the following content:

"1(1). Conditions of transfer of share in the authorized capital of society according to the subitem "zh" of Item 1 of this Decree are:

a) transfer by the foreign party of consortium or according to its order other persons on the settlement account of society of the money provided by the subitem "k" of Item 1 of this Decree;

b) the conclusion the foreign party of consortium of delivery agreements necessary for execution of the Agreement of the equipment of foreign production and spare parts to it, and also agreements on technical cooperation;

c) making by the foreign party of consortium of actions which led to cancellation of the political and economic sanctions imposed by foreign states which are negatively influencing execution of the Agreement, including if necessary their judicial appeal.".
