About introduction of amendments to the Family code No. 1316/2000
The Parliament adopts this organic law.
Art. I. - In the Family code No. 1316/2000 (Official monitor of the Republic of Moldova, 2001, Art. No. 47-48, 210), with subsequent changes, to make the following changes:
1. In part (2) Article 76 of the word "the circumstances deserving attention." shall be replaced with words "the circumstances deserving attention with observance of provisions of Article 108.".
2. Part (Article 78 to add 2) with the words "with observance of provisions of Article 108".
3. Part (Article 80 to add 3) with the words "with observance of provisions of Article 108".
4. Add Article 84 with the words "with observance of provisions of Article 108".
5. Part (Article 91 to add 2) with the words "with observance of provisions of Article 108".
6. State Article 108 in the following edition:
"Article 108. The size of the alimony appointed in firm sum of money
(1) the Size of the alimony appointed by degree of jurisdiction in firm sum of money constitutes at least 50 percent of the annual average size of subsistence minimum estimated in National bureau of statistics for the corresponding category of the population for previous year.
(2) the Size of the alimony provided by part (1), it is reviewed annually, since April, proceeding from growth of the annual average size of subsistence minimum estimated in National bureau of statistics expressed as a percentage without the need for pronouncement of the relevant new decision. If the debtor has debt on payment of the alimony, payment is performed according to the size of subsistence minimum applied at the time of its implementation.
(3) the Burden of annual review of the size of the alimony proceeding from growth of the annual average size of subsistence minimum estimated in National bureau of statistics expressed as a percentage bears debtor.
