About modification of the Code of penal procedure of the Kyrgyz Republic

Article 1.

Bring in the Code of penal procedure of the Kyrgyz Republic (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following changes:

Part 2 of Article 39 to add 1) with Item 3-1 of the following content:

"3-1) performs special investigative actions on the bases and conditions provided by paragraphs to second and third part 4 of article 219 of this Code;";

2) in Article 219:

a) to add part 4 paragraph two after words of "missing persons" with words ", and also in case of receipt of requests of foreign states about search of suspects, persons accused, convicts and missing persons";

b) add part 4 with the paragraph third the following content:

"In the presence of the court order sent to the prosecutor for providing appearance of the person accused and (or) the organization of search and also concerning the accused persons who are wanted on criminal cases, the investigation of which is suspended, the official of body of inquiry with the consent of the prosecutor initiates the petition for production of the special investigative actions provided by Items 2, of 3, of the 5 and 6 article 220 of this Code before the investigative judge.";

Part 1 of Article 222 to add 3) with the offer of the following content: "Special investigative actions on the bases provided by paragraphs to second and third part 4 of article 219 of this Code are carried out before detention of the searched persons.";

Article 230 to add 4) with part 8 of the following content:

"8. The official of body of inquiry in the presence of the bases and conditions provided by the paragraph third parts 4 of article 219 of this Code having the right to carry out listening of negotiations according to the procedure, established by this Article.";
