About introduction of amendments to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About questions of licensing of separate types of activity" of December 14, 2023 No. 678

For the purpose of systematization of the legislation, according to the Law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic", articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About questions of licensing of separate types of activity" of December 14, 2023 No. 678 the following changes:

in Regulations on the licensing of separate types of activity approved by the above-stated resolution:

- add Item 18 with the subitem 12 of the following content:

"12) factual determinations of implementation of activities for the address, not the corresponding actual address specified in license/appendix (except as specified changes of the place name), concerning the licenses provided by Chapters 24 and 25 of this provision.";

- add Item 69 with subitem 3-1 of the following content:

"3-1) changes of the place name of the place (address) of implementation of the licensed activities concerning the licenses provided by heads 24, of the 25th this provision;";

- state Chapter 24 in the following edition:

"Chapter 24. Features of licensing of the medical activities performed
private medical institutions and individual entrepreneurs
(except for activities of the health workers working on hiring or labor
to the agreement in private medical institutions or at individual entrepreneurs)

157. The license for the medical activities performed by the organizations of health care founded on private pattern of ownership and individual entrepreneurs (except for activities of the health workers working on hiring or the employment contract in the organizations of health care founded on private pattern of ownership or for individual entrepreneurs), is issued by authorized state body in the field of health care.

158. Types of activity according to appendix 1 to this Provision are subject to licensing.

159. The license for private medical activities is temporary, inaliennable, its action is limited to the territory (address) of implementation by the licensed type of activity.

160. The license for implementation of medical activities is granted for a period of five years. The license can be granted for the term of less than 5 years according to the statement of the license applicant.

161. For receipt of the license for private medical activities by the applicant the following documents are in addition submitted:

1) copies right certifying and the documents of title confirming the property right or other legal cause of ownership, use of non-residential real estate for implementation of the declared types of medical activities (technical data sheet on real estate, the purchase and sale agreement, the lease agreement and another);

2) the copy of the document confirming compliance of the medical equipment and equipment to safety regulations for patients and medical personnel (the metrological conclusion, acts of checkings, the act of the regime commission);

3) the document confirming compliance of the non-residential real estate (rooms/offices) used for implementation of the declared types of activity, to sanitary and epidemiologic regulations, rules and hygienic requirements (the act of sanitary and epidemiologic inspection);

4) agreement of utilization of medical waste (if necessary);

5) the documents confirming availability of the qualified specialists providing high-quality and safe implementation of medical types of activity (the diploma about medical education, certificates on passing of internship/internship, the existing qualification or certification certificate on the declared specialty, the service record).

162. Licensed requirements and conditions when implementing of the licensed types of private medical activities:

1) availability:

- the rooms at the license applicant belonging to him on the property rights or other corporeal right intended for accomplishment of the licensed type of activity, conforming to requirements of sanitary and epidemiologic and fire safety;

- the medical equipment, the equipment necessary for implementation of the licensed types of activity according to the minimum requirements belonging to the license applicant on the property right or other corporeal right meeting metrological standards and regulations of technical safety according to appendix 1 to this Provision;

2) implementation of medical activities in strict accordance with the legislation in the field of health care in case of obligatory observance of the following conditions:

- rendering high-quality medical services according to the existing clinical protocols, other regulatory legal acts in the field of health care and to acts of authorized body in the field of health care;

- maintaining primary medical documentation on the approved authorized body in the field of health care to samples and forms;

- maintaining accounting and reporting medical documentation on the established form of authorized body in the field of health care;

- submission to authorized body in the field of health care of the report separately on each type of activity according to form of the statistical reporting annually, in time no later than the 10th following the accounting period;

- when changing specialists - informing the licensor within 30 calendar days;
