About modification of the Criminal Procedure Code of Ukraine concerning features of pre-judicial investigation of the criminal offenses connected with disappearance of persons without message in case of special circumstances during action of warlike situation

The Verkhovna Rada of Ukraine decides:

I. Bring in the Criminal Procedure Code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2013, Art. No. No. 9-13, 88) such changes:

1. 9 parts one of Article 3 to state Item in the following edition:

"9) the head of body of prosecutor's office - the Attorney-General (person fulfilling its duties), the head of regional prosecutor's office, the head of district prosecutor's office and their first deputies and deputies acting within the powers".

2. In Article 36:

Item 2 parts two to state 1) in the following edition:

"2) to have full access to the materials, documents and other data concerning pre-judicial investigation.

The Attorney-General (person fulfilling its duties) for implementation of the powers has the right to provide written specifying to the head of body of pre-judicial investigation which is obligatory for execution, concerning provision to it materials of pre-judicial investigation with establishment of term and method of its accomplishment.

After receipt of access to materials of pre-judicial investigation the Attorney-General (person fulfilling its duties) has the right to charge to other prosecutor to perform check of compliance with laws during conducting pre-judicial investigation";
