Changes which are made to acts of the Government of the Russian Federation

1. Line item of the 5th table No. 1 of the Section II of appendix to the Regulations on federal state veterinary control (supervision) approved by the order of the Government of the Russian Federation of June 30, 2021 No. 1097 "About federal state veterinary control (supervision)" (The Russian Federation Code, 2021, No. 28, Art. 5527; 2022, No. 45, Art. 7710; 2024, No. 27, Art. 3836; 2025, No. 34, of the Art. 5142) to state in the following edition:

In Regulations on federal state control (supervision) in the field of production and turnover of tobacco products, nikotinsoderzhashchy products and raw materials for their production approved by the order of the Government of the Russian Federation of March 1, 2024 No. 249 "About approval of the Regulations on federal state control (supervision) in the field of production and turnover of tobacco products, nikotinsoderzhashchy products and raw materials for their production" (The Russian Federation Code, 2024, No. 10, the Art. 1424):

a) declare Item 12 invalid;

b) in Item 16 to replace the word of "March" with the word of "April";

d) add Item 18 with the paragraph of the following content:

The preventive visit is conducted in the form of preventive conversation by the official in the place of implementation of activities of controlled person or by use of video conferencing or the Inspector mobile application.

When carrying out survey within the obligatory preventive visit photographing and video are performed with use of the Inspector mobile application.

The obligatory preventive visit is conducted by the official according to article 52.1 of the Federal law "About the State Control (Supervision) and Municipal Control in the Russian Federation".

Within the obligatory preventive visit the official if necessary performs inspection, reclamation of necessary documents, sampling (is model), tool inspection, testing and examination.

Survey and examination within the obligatory preventive visit can be performed with use of means of remote interaction, including by means of video conferencing, and also with use of the Inspector mobile application.

Photographing or video when implementing survey within the obligatory preventive visit is carried out with use of the Inspector mobile application.

For the objects of control referred to category of considerable, average or moderate risk obligatory preventive visits are conducted with the frequency established according to Item 3 of part 2 of article 25 of the Federal law "About the State Control (Supervision) and Municipal Control in the Russian Federation".

The preventive visit at the initiative of controlled person is conducted according to article 52.2 of the Federal law "About the State Control (Supervision) and Municipal Control in the Russian Federation".

22. During the preventive visit controlled person is informed on the questions specified regarding the 2nd article 52 of the Federal law "About the State Control (Supervision) and Municipal Control in the Russian Federation" and Item 19 of this provision and also on the following questions:

a) content of the made changes applied to activities of controlled person or to the objects of control of the regulatory legal acts establishing mandatory requirements belonging to it in regulatory legal acts, and also terms and procedure for their introduction in force;

b) the most often found cases of violations of mandatory requirements to which the violations revealed within calendar year when carrying out at least than 10 percent of control (supervising) actions belong.";

"The claim to decisions, actions (failure to act) of the head of the Federal Service for control of the alcoholic and tobacco markets is considered by the head of the Federal Service on control of the alcoholic and tobacco markets.";

l) state Item 57 in the following edition:

"57. The claim is subject to consideration according to the procedure, the stipulated in Clause 43 Federal Laws "About the State Control (Supervision) and Municipal Control in the Russian Federation", within 15 working days from the date of its registration in information system (subsystem of the state information system) of pre-judicial appeal.

The claim of controlled person to the decision on reference of objects of control to the corresponding category of risk is considered no more than 5 working days in time.".
