1. Each judge provided that he worked in judgeship at least 20 years, has the right to resignation, that is to release it from fulfillment of duties at own will or in connection with the expiration of powers. The judge also has the right to resignation for health reasons, to the interfering continuation of fulfillment of duties.
2. For the judge staying in resignation the rank of the judge and the same guarantees of immunity and social protection, as well as before its leaving in resignation remains.
3. The dismissal wage without the tax discharge in the amount of monthly earnings on the last position for each complete year of work in judgeship is paid to the judge who retired, but six-months earnings suffice.
4. Pension on conditions, the stipulated in Article 37 Laws of Ukraine "About public service" is paid to the judge who retired with the corresponding age and length of service. Pension or tax-exempt monthly perpetual monetary pay in the amount of 80 percent of the salary working at the corresponding judgeship is paid to the judge in resignation having length of service in judgeship at least 20 years at its choice. For each complete year of work over 20 years in judgeship the size of monthly perpetual monetary pay increases by two percent of earnings, but it is no more than to 90 percent of earnings of the judge. To the judge in resignation having length of service in judgeship less than 20 years and who reached 55-year age (for women - 50 years), the size of monthly monetary pay is estimated in proportion to the number of complete years of work in judgeship. In case of achievement of retirement age by such judge behind it the right to monthly perpetual monetary pay in noted size, or, at its choice remains, pension on conditions, the stipulated in Article 37 Laws of Ukraine "About public service" is granted.
