Changes which are made to acts of the Government of the Russian Federation concerning intellectual property

1. In Regulations on patent and other fees for making of the legally significant actions connected with the patent for the invention, useful model, industrial design with state registration of the trademark and service mark, with state registration and provision of exclusive right on geographical specifying, the name of the place of goods origin, and also with state registration of alienation of exclusive right on result of intellectual activities or means of individualization, pledge of exclusive right, provision of right to use of such result or such means on the agreement, transition of exclusive right to such result or such means without agreement, No. 941 approved by the order of the Government of the Russian Federation of December 10, 2008 "About approval of the Regulations on patent and other fees for making of the legally significant actions connected with the patent for the invention, useful model industrial design, with state registration of the trademark and service mark, with state registration and provision of exclusive right on geographical specifying, the name of the place of goods origin, and also with state registration of alienation of exclusive right on result of intellectual activities or means of individualization, pledge of exclusive right, provision of right to use of such result or such means on the agreement, transition of exclusive right to such result or such means without agreement" (The Russian Federation Code, 2008, No. 51, Art. 6170; 2011, No. 39, Art. 5487; 2013, No. 47, Art. 6106; 2016, No. 13, Art. 1844; 2017, No. 40, Art. 5856; 2020, No. 23, Art. 3681; 2021, No. 26, Art. 4948; 2024, No. 40, Art. 5971):

a) add with Item 13 (1) the following content:

"13(1). Are exempted from payment of the duties provided by subitems 1. 17, 1.20.1.1 - 1.20.1.5, 1.20.2.1 - 1.20.2.5, 2.4 and 2.22 of appendix No. 1 to this Provision, federal bodies of the government, public authorities of subjects of the Russian Federation, and also State Atomic Energy Corporation "Rosatom" and the State corporation on space activities Roskosmos when implementing of powers by these state corporations on management of the rights to results of intellectual activities and the means of individualization equated to them belonging to the Russian Federation.";

b) the third and fourth Item 17 to state paragraphs in the following edition:

"Concerning the duties provided by subitems 1.1 - 1.3, 1.6, 1.8 - 1.10, 1.20.1.1 - 1.20.1.5 (regarding industrial designs), 2.3, 2.4 and 2.22 of appendix No. 1 to this Provision, the petition moves respectively in case of submission of documents of the request, petition for modification of documents of the request for the invention, petitions for conducting examination in essence according to the request for the invention, statements for prolongation of effective period of exclusive right on industrial design or the trademark.

Concerning the duties provided by subitems 1. 17, 1.20.1.1 - 1.20.1.5 (regarding inventions), 1.20.2.1 - 1.20.2.5 and 2.13 appendices No. 1 to this Provision, the petition move respectively before the expiration of payment of duties on registration of the invention, useful model, industrial design, for maintenance in force of the patent for the invention or useful model, for registration of provision of exclusive right for geographical specifying, the name of the place of the goods origin provided by this Provision.";

c) in appendix No. 1 to the specified Provision:

Rules of management of the rights to results of intellectual activities belonging to the Russian Federation, including the rights to the results of intellectual activities which are directly connected with ensuring defense and safety, approved by the order of the Government of the Russian Federation of December 29, 2021 No. 2550 "About approval of Rules of management of the rights to results of intellectual activities belonging to the Russian Federation, including the rights to the results of intellectual activities which are directly connected with ensuring defense and safety, and recognition voided some acts and separate provisions of some acts of the Government of the Russian Federation" (Russian Federation Code, 2022, No. 1, Art. 242), to add with Item 27 (1) the following content:
