About modification and amendments in the order of the Deputy prime minister of the Republic of Kazakhstan – the Minister of Agriculture of the Republic of Kazakhstan of October 26, 2018 No. 436 "About approval of Rules of subsidizing of rates of remuneration when crediting subjects of agro-industrial complex, and also leasing for acquisition of farm animals, the equipment and processing equipment"

I ORDER:

1. Bring in the order of the Deputy prime minister of the Republic of Kazakhstan – the Minister of Agriculture of the Republic of Kazakhstan of October 26, 2018 No. 436 "About approval of Rules of subsidizing of rates of remuneration when crediting subjects of agro-industrial complex, and also leasing for acquisition of farm animals, the equipment and processing equipment" (it is registered in the Register of state registration of regulatory legal acts No. 17741) the following changes and amendments:

in Rules of subsidizing of rates of remuneration when crediting subjects of agro-industrial complex, and also leasing for acquisition of the farm animals, the equipment and processing equipment (further – Rules) approved by the specified order:

state item 4 in the following edition:

"4. Subsidizing is performed according to loan agreements on acquisition of agricultural machinery, including the hinged and trailing equipment, and also on acquisition of farm animals, on the investment purposes (except for automobile road transport and passenger transport), construction (except for loans on acquisition of fixed assets on production of flour, mineral waters and soft drinks).

According to the loan agreements specified in part one of this Item, subsidizing is performed no more nominal rate of remuneration calculated as total expression of base rate of National Bank of the Republic of Kazakhstan plus 7,5 (seven whole five tenth) percent (further – %) annual in tenge.

By consideration of the offer the base rate of National Bank of the Republic of Kazakhstan operating at the time of the conclusion of the loan agreement is applied.

According to the loan agreements specified in part one of this Item (except for the case provided by part seven of this Item), and concluded since January 25, 2022 by the borrower 6 (six) % of nominal rate of remuneration are paid, from the government budget the rest of nominal rate of remuneration received as a result of difference between the amount of base rate of National Bank of the Republic of Kazakhstan plus 7,5 (seven whole five tenth) % per annum and 6 (six) % paid by the borrower in tenge is subsidized.

At the same time, the borrower pays 6 (six) % of nominal rate of remuneration for the loan agreements specified in the parts one of this Item providing acquisition of priority farm vehicles and the equipment, and also providing acquisition of additional agricultural machinery and the equipment according to appendix 2-1 to these rules.

The list of priority farm vehicles and the equipment is provided by authorized body in the field of the state support of industrial activities no later than December 1 of the current year the next year and no later than July 1 for the corresponding year. Within 3 (three) working days after obtaining the List of priority farm vehicles and the equipment is placed authorized body in the field of development of agro-industrial complex in GISS.

According to other loan agreements specified in part one of this Item, and providing acquisition of agricultural machinery, including the hinged and trailing equipment, the borrower is paid with 15 (fifteen) % of nominal rate of remuneration, from the government budget the rest of nominal rate of remuneration received as a result of difference between the amount of base rate of National Bank of the Republic of Kazakhstan plus 7,5 (seven whole five tenth) % per annum and 15 (fifteen) % paid by the borrower in tenge is subsidized.

According to the loan agreements specified in part one of this Item, and concluded till January 25, 2022 with nominal rate of remuneration no more than 17 (seventeen) % per annum in tenge decrease in rates of remuneration by 10 (ten) percent (further – %) annual is provided in tenge.

According to the current agreements of subsidizing signed till December 4, 2021 within the loan agreements issued in Russian rubles and other currency decrease in rate of remuneration lower than 4 (four) % per annum in Russian rubles is not allowed, it is lower than 3 (three) % per annum in other currency.";

state Item 11 in the following edition:

"11. The loan agreements existing for date of submission of the offer and concluded not earlier than 4 (four) years before submission of the offer are subject to subsidizing.

The loan agreement according to which the decision on the subsidizing termination was made is allowed to repeated participation in the program no more than 1 (one) time.

According to the loan agreements which are repeatedly participating in the program, subsidizing is recovered from the date of submission of the offer by the borrower on repeated participation on the former conditions specified in earlier cancelled agreement of subsidizing regarding standard rates, subsidizing terms, without increase in earlier approved amount of subsidies, excepting the requirement for term in 4 (four) years, from date of submission of the offer by the borrower, except as specified, of the these rules provided by part three of Item 15.";

state Item 15 in the following edition:

"15. In case of change of terms of the contract of loan (except for the case provided by part three of this Item), earlier approved and added amount of subsidies does not increase, the term of subsidizing is not prolonged.

This restriction does not extend to loan agreements, in case of provision of delay by financial institutions on payment of rate of remuneration and (or) repayment of principal debt for the term of no more than 24 (twenty four) months in connection with approach of the worsening circumstances for the borrower (uslugopoluchatel) according to documents of authorized bodies, including as a result of introduction of emergency state according to article 5 of the Law of the Republic of Kazakhstan "About emergency state" or announcements of emergency situation of natural and technogenic nature according to article 48 of the Law of the Republic of Kazakhstan "About civil protection".

At the same time in case of increase in the amount of remuneration in connection with provision of delay on payment of rate of remuneration and (or) repayment of principal debt for the term of no more than 24 (twenty four) months recalculation of the amount of subsidies towards increase is made, prolongation of the current agreement of subsidizing is also allowed.

According to loan agreements according to which at the time of prolongation the duration of the agreement of subsidizing expired prolongation of the agreement of subsidizing by submission of the offer on repeated participation with the increase in term and the amount of the agreement of subsidizing in accordance with the terms provided by parts two and third this Item is allowed.";

state Items 24 and 25 in the following edition:

"24. According to the approved offers the conclusion of the agreement of subsidizing and payment of subsidies are performed on priority according to date and time of receipt of offers.

In case of lack of additional budgetary funds in the current financial year, payment of subsidies is performed in the following financial year.

Acceptance of offers is performed on condition of availability in the budget of means.

25. In the presence of budgetary funds, free from obligations, the working body (service provider) sends to the borrower (uslugopoluchatel) and financial institution the notification on the conclusion of the agreement of subsidizing, observing procedure for priority, the arrived offers.";

6) of Item 26 to state the subitem in the following edition:

"6) termination or termination of the contract of loan, except as specified, the these rules specified in part four of Item 15.";

state Item 36 in the following edition:

"36. In case of formation of remaining balance of unused means on the special account their return by financial institution to working body (service provider) in the following cases is provided:

1) in case of exception of the program of the borrower (uslugopoluchatel) – within 1 (one) month after decision making by working body (service provider);

2) in case of change of conditions of the current agreement of loan, and also early repayment of principal debt by the borrower (uslugopoluchatel) – within 1 (one) month after submission of the quarterly reporting;

3) in case of non-execution by the borrower (uslugopoluchatel) of obligations on repayment of planned payment of principal debt and (or) remuneration more than 90 (ninety) calendar days in a row – within 1 (one) month from the date of receipt of information from working body (service provider) on the termination of subsidizing of the borrower (uslugopoluchatel).

At the same time return of the payments made in the current financial year is performed by recovery of cash expenses of working body (service provider) by increase in the amount of pending obligations and reduction of cash expenses by the corresponding codes of budget classification of expenses according to the order of the Minister of Finance of the Republic of Kazakhstan of April 4, 2025 No. 149 "Some questions of Single budget classification of the Republic of Kazakhstan".

In case of return of payments of last years the amount of return is credited in the income of the relevant budget from which payments were made.";

state Items 86 and 87 in the following edition:

"86. The amount of direct subsidizing of rates of remuneration of financial institutions (uslugopoluchatel) is calculated by the following formula:

RPS = (BS NB RK + 2%) x amount of funding plan plus remaining balance of principal debt according to the signed loan agreements,

where:

RPS – the amount of direct subsidizing, tenge;

BS NB RK – base rate of National Bank of the Republic of Kazakhstan as of the date preceding day of provision of the request of financial institution (uslugopoluchatel) for participation in the program;

amount of funding plan of financial institution – the predicted amount of crediting, leasing of subjects of agro-industrial complex according to the program for planning period of financial year;

remaining balance of principal debt according to the signed loan agreements – remaining balance of principal debt of the subjects of agro-industrial complex who obtained the credit, leasing according to the program.

87. The size of base rate of National Bank of the Republic of Kazakhstan applied to calculation of the amount of direct subsidizing of rates of remuneration of financial institutions (uslugopoluchatel) remains invariable on all duration of the agreement of loan.";

add with Item 87-1 of the following content:

"87-1. In case of change of the size of base rate of National Bank of the Republic of Kazakhstan applied to calculation of the amount of direct subsidizing of rates of remuneration of financial institutions (uslugopoluchatel), the financial institution (uslugopoluchatel) sends to the Ministry the notification on adjustment of amount of subsidized means in form according to appendix 17-1 to these rules.";

"2-1) availability of score of the international rating agency with assessment not below "B" assigned to financial institution for the last 2 (two) years;";

"92. Order taking of financial institutions (uslugopoluchatel) for participation in the program is performed by the Ministry as required during the period from January 10 to December 1 accounting year by means of GISS.";

"94. In the presence of the order of the Government of the Republic of Kazakhstan about assignment from reserve of the Government of the Republic of Kazakhstan providing allocation to financial institution (uslugopoluchatel) of means of subsidies in the amount of 100 (hundred) % or in the presence in the republican budget for the corresponding financial year of funds for subsidizing the Ministry within 5 (five) working days from decision date about approval of the request of financial institution (uslugopoluchatel) for participation in the program signs with financial institution (uslugopoluchatel) the agreement of direct subsidizing in form according to appendix 20 to these rules.";
