About modification of the Order of the Government No. 977/2016 about approval of the Standard provision on operation of water storage basins/ponds

Based on Item b) parts (1) Article 7 and Item b) parts (2) article 62 of the Law No. 272/2011 on water (repeated publication: The official monitor of the Republic of Moldova, 2024, Art. No. 46-49, 70), with subsequent changes, DECIDES: the Government

In the Order of the Government No. 977/2016 about approval of the Standard provision on operation of water storage basins/ponds (Official monitor of the Republic of Moldova, 2016, Art. No. 265-276, 1060), with subsequent changes, to make the following changes:

1.1. in the resolution:

1.1.1. in the name and in Item 1 after the text of "water storage basins/ponds" to add with the text "/bulk ponds for fish farming";

1.1.2. in acceptance formula the text "part (Article 38" to exclude 3);

1.1.3. state Item 2 in the following edition:

"2. Owners of dikes provide development of provision on operation of water storage basins/ponds / bulk ponds for fish farming. Owners/superficiaries/lessees of water storage basins / ponds / bulk ponds for fish farming, irrespective of their form of business, perform necessary actions for their operation based on own regulations developed according to the approved Standard provision.";

1.1.4. Items 3, of 4, of 5, 6-1 and 6-2 to recognize invalid;

1.1.5. state Item 6 in the following edition:

"6. Owners of the parcels of land on which water storage basins/ponds / bulk ponds for fish farming are located provide transfer to lease, and lessees have the right to transfer to the sublease of part of the parcels of land with use of coastal water preserving strips according to the Regulations on land development of water fund and hydraulic engineering constructions approved by the Order of the Government No. 403/2024, for placement of water intakes and portable installations for irrigation of farmlands and on the conditions stated in provision on operation of water storage basin / pond / bulk pond for fish farming. Access to special water use on water storage basins/ponds / bulk ponds for fish farming is provided to water users according to the priorities established according to legislation provisions.";

1.1.6. add with Item 6-3 of the following content:

"6-3. Owners of reservoirs, ponds and bulk ponds for fish farming draw up technical data sheet only according to appendix No. 1 to the approved Standard provision.";

1.2. in the Standard provision:

1.2.1. in all text:

1.2.1.1. the words "Service of Civil Defence and Emergency Situations" in any grammatical form shall be replaced with words "General inspectorate on emergency situations" in the corresponding grammatical form;

1.2.4. state Item 6 in the following edition:

"6. The provision on operation of water storage basin/pond / bulk pond for fish farming is the technical document on operation of single and indivisible water object based on which use of water resources and other natural resources with observance of conditions of environmental protection, streamlining of waterway, and also accomplishment of obligations on content and repair of hydraulic engineering constructions in the terms established by technical data sheet of the hydraulic engineering construction according to regulations and based on observations of behavior of constructions in operation shall be performed.";

1.2.5. add with Items 6-1 and 6-2 of the following content:

"6-1. Provision on operation of water storage basin/pond / bulk pond for fish farming and, in appropriate cases - technical cards are approved and registered public organization "National Administration of "Apele Moldovei"", with entering of data into the automated information system "State Water Inventory".

62. Provisions on operation are developed by the certified specialists in the field of designing of hydraulic engineering constructions.";

1.2.6. state Item 7-1 in the following edition:

"7-1. For the purposes of this Standard provision the following concepts mean:

the measuring graduated lath - lath with an accuracy of 1 cm on which the normal retaining level, level to which the water intake for irrigation is allowed (the maximum level of emergency ration of water for fish breeding) is specified, and the level of dead amount, established on wet slope or on mine spillway;
