About modification of the Order of the Government No. 886/2010 about approval of the Regulations on procedure for determination of the amount of charges for making of acts of the legal executive and costs of enforcement proceeding

Based on article 47 of the Law No. 113/2010 on legal executives (repeated publication: The official monitor of the Republic of Moldova, 2024, Art. No. 73-75, 98), with subsequent changes, DECIDES: the Government

1. In the Order of the Government No. 886/2010 about procedure for determination of the amount of charges for making of acts of the legal executive and costs of enforcement proceeding (Official monitor of the Republic of Moldova, 2010, 191-193, Art. 977), with subsequent changes, to make the following changes:

1.1. in the resolution:

1.1.1. to state formula of acceptance in the following edition:

"Based on part (5) article 47 of the Law No. 113/2010 on legal executives (repeated publication: The official monitor of the Republic of Moldova, 2024, Art. No. 73-75, 98), with subsequent changes, DECIDES: the Government";

1.1.2. state Item 2 in the following edition:

"2. Since 2028 the amount of charges for making of acts of the legal executive and costs of enforcement proceeding can be corrected after three-year cycle from the moment of the last adjustment till February 15 of the year following after the last year of cycle taking into account the inflation index for the corresponding period and influences of inflation on expenses according to procedures of forced execution.";

1.1.3. add with Item 3 following of content:

"3. In case the indicator of the rate of inflation for the period provided in Item 2, exceeds 30%, use of the amount of charges for making of actions of the legal executive and costs of the enforcement proceeding corrected according to Item provisions 2, will be performed step by step within three years of three-year cycle by gradual increase in the initial amount - in terms and in proportions which are established in Item 2.";
