About modification of some legal acts of the Kyrgyz Republic concerning bank legal relationship

Article 1.

Bring in part II of the Civil code of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1998, No. 6, the Art. 226) the following changes:

Item 5 of Article 451 to state 1) in the following edition:

"5. The obligation of the buyer can be provided by the purchase and sale agreement to pay percent on the amount corresponding to the goods price since day of transfer of goods by the seller, taking into account requirements, stipulated by the legislation in the field of consumer loan.";

Article 734 to add 2) with the paragraph of the following content:

"To the legal relationship arising in connection with the conclusion of the agreement of consumer loan, provisions of this paragraph are applied taking into account the features established by the legislation in the field of consumer loan.";

3) in Article 736-3:

a) in Item 1 "bank" to replace the word with the word "creditor";

b) the paragraph one of Item 2 to state in the following edition:

"2. The creditor in case of the conclusion of the credit agreement with each specific borrower independently determines the size, frequency of charge and payment due dates of percent and commission fee if the obligation of its payment is provided by the credit agreement, taking into account requirements, stipulated by the legislation the Kyrgyz Republic.";

Article 738-9 to add 4) with Item 5 of the following content:

"5. To the legal relationship arising in connection with the conclusion of the contract of murabakh for the consumer purposes, provisions of this Chapter are applied taking into account the features established by the legislation in the field of consumer financing.";
