About the lease agreement of the wood lot which is in the state-owned or municipal property

1. Approve enclosed:

Rules of preparation and the conclusion of the lease agreement of the wood lot which is in the state-owned or municipal property;

form of the approximate lease agreement of the wood lot.

2. Recognize to invalid:

the order of the Government of the Russian Federation of March 24, 1998 N345 "About Approval of the Regulations on Lease of Sites of Forest Fund" (The Russian Federation Code, 1998, N 14, the Art. 1585);

the order of the Government of the Russian Federation of June 19, 2003 N349 "About Modification and Amendments in Regulations on Lease of Sites of Forest Fund" (The Russian Federation Code, 2003, N 25, the Art. 2532);

the order of the Government of the Russian Federation of May 20, 2005 N313 "About Modification of the Regulations on Lease of Sites of Forest Fund" (The Russian Federation Code, 2005, N 22, the Art. 2122);

Item of 1 changes which are made to orders of the Government of the Russian Federation concerning use of the lands of forest fund approved by the order of the Government of the Russian Federation of November 18, 2006 N698 "About Modification of Some Orders of the Government of the Russian Federation concerning Use of Lands of Forest Fund" (The Russian Federation Code, 2006, N 48, by the Art. 5029).

Rules of preparation and the conclusion of the lease agreement of the wood lot which is in the state-owned or municipal property

1. These rules determine procedure for preparation and the conclusion of the lease agreement of the wood lot which is in the state-owned or municipal property (further respectively - the agreement, the wood lot).

2. Provision of the timberland in lease is performed according to the Forest code of the Russian Federation. The regulations on lease provided by the Civil code of the Russian Federation are applied to the agreement if other is not established by the Forest code of the Russian Federation.

Only the wood lot which underwent the state cadastral registration can be object of lease after January 1, 2010.

Till January 1, 2010 provision to citizens, legal entities of the timberland as a part of lands of forest fund without carrying out the state cadastral registration is allowed.

3. Under the agreement the wood lot is provided for one or several following purposes:

a) wood procurement;

b) gallipot procurement;

c) procurement and collection of not wood forest resources;

d) procurement of food forest resources and collection of herbs;

e) maintaining hunting economy;

e) farming;

g) implementation of research and educational activities;

h) implementation of recreational activities;

i) creation of forest plantations and their operation;

j) cultivation forest fruit, berry, decorative and herbs;

k) performance of works on geological studying of subsoil and development of mineral deposits;

l) construction and operation of water storage basins and other artificial water objects, and also hydraulic engineering constructions and specialized ports;

m) construction, reconstruction and operation of power lines, communication lines, roads, pipelines and other linear objects;

o) conversion of wood and other forest resources;

o) accomplishment of prospecting works;

p) other purposes determined according to part 2 of Article 6 of the Forest code of the Russian Federation.

4. The agreement is signed by results of auction for sale of the right to the conclusion of the agreement, except for the following cases:

a) use of the woods for performance of works on geological studying of subsoil and developments of mineral deposits;

b) use of the woods for construction and operation of water storage basins and other artificial water objects, and also hydraulic engineering constructions and specialized ports;

c) use of the woods for construction, reconstruction and operation of power lines, communication lines, roads, pipelines and other linear objects;

d) implementation of priority investment projects in the field of development of the woods;
