About modification of some regulations (accomplishment of resolutions of the Constitutional court and enhancement of the mechanism of voluntary execution of executive documents)
The Parliament adopts this organic law.
Art. I. - In the Code of civil procedure of the Republic of Moldova No. 225/2003 (repeated publication: The official monitor of the Republic of Moldova, 2018, Art. No. 285-294, 436), with subsequent changes to make the following changes:
1. Part (Article 241 to state 7) in the following edition:
"(7) In case the degree of jurisdiction turns the decision to immediate execution, in substantive provisions of this decision the reasonable time for voluntary execution provided by part is established (1-1) Article 256. In case of variation of requirements of the claimant the degree of jurisdiction the decision cancels measures for providing the claim.".
2. State Article 255 in the following edition:
"Article 255. Execution of the decision
The judgment is subject to voluntary execution in the procedure established by the law not later than in 15-day time from the date of its introduction in final force, except for judgments, stipulated in Article 256. After the term provided by this Article or the term established according to part (11) Article 256, the creditor can require forced execution according to the Executive code.".
3. Add Article 256 with part (1-1) following contents:
"(1-1) Degree of jurisdiction which passed the writ or the judgment provided by part (1), reasonable time for voluntary execution by the defendant of the obligation who shall not exceed 15 days from the moment of pronouncement of the writ or the judgment establishes in substantive provisions of the decision.".
4. To declare the Item e 1) of Article 267 invalid.
5. In part (1) Article 353 of the word "the determination which is not subject to appeal about variation of objections." shall be replaced with words "determination about variation of objections.".
