About rules and standards of safety for passenger ships

The Parliament adopts this organic law.

This law partially shifts (Article 1-9, 12, of 13, 15 and appendix III) the Directive 2009/45/EU of the European parliament and Council of May 6, 2009 about rules and standards of safety for passenger ships, CELEX: 332009L0045, published in the Official magazine of the European Union by L 163 of June 25, 2009, with the last changes made by the Delegated regulations of the Commission (EU) 2022/1180 of January 11, 2022.

Chapter I. General provisions

Article 1. Subject of the law

Subject of this law is establishment of the regulatory base for ensuring single level of safety of life of the people and property which are onboard passenger ships and high-speed passenger watercrafts during making of internal flights by them, and also establishment of procedure for negotiating at the international level for the purpose of harmonization of the rules applicable to the passenger ships and watercrafts making the international flights.

Article 2. Scope of application

(1) This law is applied to the following passenger ships and watercrafts, irrespective of their flag, making internal flights:

a) to the new or existing passenger ships 24 meters long and more;

b) to high-speed passenger watercrafts.

(2) This law is not applied:

1) to passenger ships which are:

a) the public vessels or courts intended for movement of troops;

b) sailing ships;

c) the courts set in motion not by mechanical means;

d) the courts constructed of other materials except steel or equivalent material and which are not regulated by the standards applicable to high-speed watercrafts or to courts with the dynamic principle of maintenance;

e) wooden vessels of primitive design;

f) traditional courts;

g) pleasure yachts;

h) the courts floating only in port zones;

i) ocean office ships or office courts;

2) to high-speed passenger watercrafts which are:

a) the military watercrafts or watercrafts intended for movement of troops;
